Resumen
El presente trabajo consiste en demostrar: por un lado, que en la sentencia del
Caso López Soto y otros vs. Venezuela, la Corte Interamericana de Derechos
Humanos si bien determinó la responsabilidad del Estado venezolano por el
incumplimiento de su obligación general de respetar los derechos humanos ante
los hechos de secuestro y violencia sexual ocurridos en agravio de Linda López
Soto en el año 2021, de acuerdo con los argumentos esgrimidos, se trataría del
incumplimiento de la obligación general de garantía, en la medida de que la Corte
IDH al analizar este punto, lo hizo a partir de las obligaciones específicas:
prevención, investigación, sanción y reparación, las mismas que de acuerdo a
los estándares internacionales pertenecen a la obligación general de garantía.
En este sentido, veremos entonces que el Estado Venezolano incumplió las
obligaciones generales de respetar y garantizar los derechos humanos. Por otro
lado, intenta evidenciar la violación del derecho de garantía judiciales como son
principalmente: acceso a la justicia y plazo razonable en agravio de Linda López
Soto y de sus familiares ejercido por los operadores jurídicos del Estado
venezolano previo y posterior a su rescate, en esa línea, se concluye que la Corte
IDH analiza superficialmente los factores que inciden en la violencia de género y
en la impunidad de la agraviada.
The present work consists of demonstrating: on the one hand, that in the judgment of the López Soto et al. vs. Venezuela Case, the Inter-American Court of Human Rights, although it determined the responsibility of the Venezuelan State for failing to comply with its general obligation to respect human rights in the face of the kidnapping and sexual violence that occurred against Linda López Soto in 2021, according to the arguments raised, it would be a breach of the general obligation of guarantee, to the extent that the IACHR, when analyzing this point, did so based on the specific obligations: prevention, investigation, sanction and reparation, the same ones that according to international standards belong to the general obligation of guarantee. In this sense, we will then see that the Venezuelan State failed to comply with the general obligations to respect and guarantee human rights. On the other hand, it attempts to demonstrate the violation of the right to judicial guarantees, such as mainly: access to justice and a reasonable time limit to the detriment of Linda López Soto and her family, exercised by the legal operators of the Venezuelan State before and after her rescue. Along these lines, it is concluded that the IACHR superficially analyzes the factors that influence gender violence and the impunity of the aggrieved party.
