Informe jurídico sobre la resolución del Tribunal Constitucional Nº 00199-2017-PA/TC

Abstract

La Resolución del Tribunal Constitucional Nº 00199-2017-PA/TC aborda un conflicto relacionado con la protección del patrimonio cultural y el derecho a la libertad de empresa, para el uso del derecho de propiedad, de Gremcitel S.A. La controversia que deriva de este caso surge con la declaratoria de los terrenos aledaños al Morro Solar como intangibles y la declaratoria del propio Morro Solar como patrimonio cultural de la Nación por el Instituto Nacional de Cultura. Ello aparentemente impidió que la empresa Gremcitel S.A. pueda desarrollar su proyecto urbanístico denominado Costazul en los terrenos aledaños al Morro Solar, ya que esta había obtenido la titularidad de los terrenos bajo concursos públicos de la Municipalidad de Chorrillos. En el presente trabajo, se abordará la composición del derecho a la protección del patrimonio cultural y el derecho a la libertad de empresa. Asimismo, se establecerán los métodos para armonizar ambos derechos ante un conflicto. Ello en base a un análisis constitucional de la norma en conflicto, la ponderación de dichos derechos, el análisis de la competencia de la Municipalidad de Chorrillos para finalmente analizar la improcedencia del proceso de amparo presentado por Gremcitel S.A.Constitutional Court Resolution No. 00199-2017-PA/TC addresses a conflict related to the protection of cultural heritage and the right to freedom of enterprise, for the use of the right to property, of Gremcitel S.A. The controversy arising from this case arises with the declaration of the land surrounding Morro Solar as intangible and the declaration of Morro Solar itself as cultural heritage of the Nation by the National Institute of Culture. This apparently prevented Gremcitel S.A. from developing its urban development project called Costazul on the land adjacent to Morro Solar, since it had obtained title to the land through public bidding by the Municipality of Chorrillos. This paper will address the composition of the right to the protection of cultural heritage and the right to freedom of enterprise. It will also establish the methods to harmonize both rights in the event of a conflict. This will be based on a constitutional analysis of the norm in conflict, the weighting of said rights, the analysis of the competence of the Municipality of Chorrillos and finally the analysis of the inadmissibility of the amparo proceeding filed by Gremcitel S.A.
