Abstract
Producto del procedimiento administrativo iniciado por la empresa Nutrifish S.A.C.
contra el Ministerio de la Producción (PRODUCE) ante la Comisión de Eliminación
de Barreras Burocráticas (Comisión) del Instituto Nacional de Defensa de la
Competencia y de la Protección de la Propiedad (INDECOPI), se declaró como
barreras burocráticas ilegales todas las exigidas por esta empresa. Este órgano
determinó que existía una vulneración al principio de legalidad por la contravención
del artículo 9 de la Ley General de Pesca – Decreto Ley 25977.
Dicha resolución final quedó firme, imposibilitando al administrado utilizar algún
recurso administrativo para solicitar la nulidad de este. Ante ello, lo que procede a
realizar PRODUCE es una solicitud de nulidad de oficio ante la secretaria técnica
de la Comisión, el cual eleva al superior jerárquico para que dé respuesta a esta.
La Sala Especializada en Eliminación de Barreras Burocráticas (Sala) admite a
trámite la solicitud procediendo a evaluar la existencia de un vicio que afecte la
validez de la resolución emitida por la Comisión y la existencia de una vulneración
de un derecho fundamental o un grávido a un interés público.
Así pues, la elección del presente expediente evidencia la posibilidad de realizar un
análisis sobre las decisiones tomadas por estos dos órganos sobre el cual es
posible cuestionar su análisis jurídico sobre barreras burocráticas y la petición de
gracia para la toma de sus decisiones de acuerdo a la Ley del Procedimiento
Administrativo General- Ley 27444, y la Ley de Prevención y Eliminación de
Barreras Burocráticas – Decreto Legislativo 1256.
As a result of the administrative proceeding initiated by the company Nutrifish S.A.C. against the Ministry of Production (PRODUCE) before the Commission for the Elimination of Bureaucratic Barriers (Commission) of the National Institute for the Defense of Competition and Protection of Intellectual Property (INDECOPI), all requirements imposed by this company were declared illegal bureaucratic barriers. This body determined that there was a violation of the principle of legality due to the contravention of Article 9 of the General Fisheries Law – Decree Law 25977. The final resolution became final, preventing the party from using any administrative remedy to request its annulment. In response, PRODUCE is required to file a request for annulment ex officio with the technical secretariat of the Commission, which then forwards it to the hierarchical superior for a response. The Specialized Chamber for the Elimination of Bureaucratic Barriers (Chamber) admits the request and proceeds to evaluate the existence of a defect affecting the validity of the resolution issued by the Commission and the existence of a violation of a fundamental right or harm to a public interest. Thus, the selection of this case file demonstrates the possibility of conducting an analysis of the decisions made by these two bodies, which may be subject to legal scrutiny regarding bureaucratic barriers and the discretionary power for their decisions in accordance with the General Administrative Procedure Law – Law 27 444 and the Law on the Prevention and Elimination of Bureaucratic Barriers – Legislative Decree 1256.
