Abstract
El presente informe tiene como objetivo el analizar de manera critica la Casación
Laboral Nº 8600-2022-Lima Sur. Esta casación trata sobre el despido de una
trabajadora bajo la causal de falta grave contemplado en el inciso a) del artículo
25 del TUO del Decreto Legislativo Nº 728 de la LPCL. En base a ello, vamos a
estudiar las características de los diferentes supuestos de faltas graves que
encontramos en el mencionado inciso. Asimismo, vamos a analizar los diferentes
supuestos de despidos contemplados en la legislación peruana y las
consecuencias jurídicas de cada una de ellas, como también los alcances del ius
variandi, el derecho de resistencia y sus implicancias en la relación laboral. Otro
punto importante, es respecto a la formalidad exigida por ley en virtud al despido,
así se observa de los hechos, que no se cumplieron en el presente caso, ya que
en la carta de despido se le añadieron dos (2) causales más que no estaban
contemplados en la carta de preaviso vulnerando el derecho de defensa de la
trabajadora. Luego, pasaremos a reflexionar los diferentes criterios de los jueces
tanto de la primera instancia como de la segunda instancia para compararlo
luego con los criterios de los jueces supremos de la Corte Suprema de Justicia
de la República. Lo antes mencionado, nos va permitir concluir que, el despido
que sufrió la trabajadora devino en fraudulento.
This report deals with the critical analysis of Labor Cassation No. 8600-2022- Lima Sur. This cassation deals with dismissing a worker under the cause of serious misconduct contemplated in subsection a) of article 25 of the TUO of Legislative Decree No. 728 of the LPCL. Based on this, we will study the characteristics of the different cases of serious offenses that we find in the section above. Likewise, we are going to analyze the different cases of dismissal contemplated in Peruvian legislation and the legal consequences of each of them, as well as the scope of the ius variandi, the right of resistance and its implications in the employment relationship. Another important point is regarding the formality required by law by the dismissal, as can be seen from the facts, which were not met in the present case, since in the dismissal letter two (2) more causes were added than They were not contemplated in the notice letter, violating the worker's right to defense. Then, we will compare the different criteria of the judges of both the first and second instances to compare it with the criteria of the supreme judges of the Supreme Court of Justice of the Republic. The aforementioned will allow us to conclude that the dismissal suffered by the worker became fraudulent.
