Abstract
El presente informe versa sobre el análisis realizado a la resolución N°7 del
expediente 00581-2019-0-1817-SP-CO-02 emitida por la Segunda Sala Civil
Subespecialidad Comercial de la Corte Superior de Justicia de Lima, la cual trata sobre
el recurso de anulación interpuesto por el PROYECTO ESPECIAL DE
INFRAESTRUCTURA NACIONAL- PROVIAS DEL MINISTERIO DE
TRANSPORTES Y COMUNICACIONES – PROVÍAS NACIONAL contra el laudo de
fecha 22 de julio de 2019 emitido en el arbitraje seguido contra OBRAS DE
INGENIERÍA S.A - OBRAINSA. A través de este informe, analizamos el problema
acerca de la motivación que se produce en los laudos arbitrales, lo cual conlleva a abrir
una ventana a que en sede judicial pueda revisarse de manera externa la decisión de estos
laudos arbitrales y comprobar si efectivamente se cumplió o no con motivar el laudo
arbitral. En ese sentido, en el presente informe, se concluye que la inexistencia de
motivación en el laudo arbitral, transgrede el derecho a la debida motivación, no cumple
con el principio de congruencia procesal y termina siendo correcto solicitar la anulación
del laudo mediante el artículo 63 numeral 1 inciso b) del Decreto Legislativo 1071. Este
análisis se desarrollará conforme a la revisión doctrinaria y jurisprudencial efectuada para
el presente informe.
This report deals with the analysis carried out on Resolution No. 7 of the file 00581-2019-0-1817-SP-CO-02 issued by the Second Civil Chamber Commercial Subspecialty of the Superior Court of Justice of Lima, which deals with the annulment action filed by the SPECIAL PROJECT OF INFRASTRUCTURE NATIONAL PROVIAS OF THE MINISTRY OF TRANSPORT AND COMMUNICATIONS PROVÍAS NACIONAL against the award dated July 22, 2019 issued in the arbitration against OBRAS DE INGENIERIA SA - OBRAINSA. Through this report, we analyze the problem regarding the motivation that occurs in arbitration awards, which leads to opening a window so that the decision of these arbitration awards can be reviewed externally and check whether it was actually complied with or not with justifying the arbitration award. In this sense, in this report, it is concluded that the absence of reasons in the arbitration award, violates the right to due reason, does not comply with the principle of procedural consistency and ends up being correct to request the annulment of the award through article 63 numeral 1 subsection b) of Legislative Decree 1071. This analysis will be developed in accordance with the doctrinal and jurisprudential review carried out for this report.
