Resumen
El objetivo del presente informe jurídico es analizar el recurso de Nulidad No 1842-2016-Lima,
mediante el cual planteo un problema principal y dos secundarios. En el problema principal
analizo la sanción del funcionario público por el delito de colusión a pesar de la no
intervención ni sanción del tercero interesado, donde concluyó que no es posible únicamente
sancionar al funcionario. Seguidamente, en el primer problema secundario analizo el uso de
la prueba indiciaria para la acreditación de la concertación como elemento primordial para
la configuración del delito de colusión, concluyendo que hay una falta de pluralidad y
concordancia en los indicios del caso. Por último, cuestionó que se haya condenado a Alex
Kouri por el delito de colusión, dado que concluyo que el tipo penal aplicable era el de
negociación incompatible.
Se utilizará el método exegético, dogmático y funcional. El método exegético y dogmático
permitirá el análisis de la doctrina y jurisprudencia vinculada a los principales elementos del
delito de colusión, las teorías y tesis aplicables, y, por último, el método funcional facilitará el
razonamiento de la discusión de la solución a los problemas jurídicos planteados. (RAMOS

The objective of this legal report is to analyze the Nullity appeal No. 1842-2016-Lima, through which I raise a main problem and two secondary ones.
