En defensa del derecho a un plazo razonable: postulación de contenidos a criterios jurisprudenciales utilizados para el otorgamiento de un plazo suplementario de investigación

Abstract
El plazo suplementario de la investigación en el proceso penal, permite que, ante
una oposición al requerimiento de sobreseimiento, el Juez amplié dicho plazo de
forma excepcional; y ello debería ser otorgado previa evaluación de los criterios
jurisprudenciales para determinar si se ha vulnerado o no el derecho a un plazo
razonable. Sin embargo, advirtiéndose que el criterio denominado “evaluación de la
gravedad del daño”, no se encuentra debidamente delimitado es que la presente
investigación busca precisar el tipo de daño a tomar en cuenta; así también,
incorporar el criterio “conducta de los representantes del Ministerio Público” por
cuanto no es posible que se limite solo a la conducta de las autoridades judiciales,
cuando el plazo de investigación en el proceso penal, está dirigido por el
representante del Ministerio Público.
The supplementary term of the investigation in criminal proceedings allows the judge to extend the term exceptionally in the event of an opposition to the request for dismissal, and this should be granted after evaluating the jurisprudential criteria to determine whether or not the right to a reasonable term has been violated. However, noting that the criterion called "evaluation of the seriousness of the damage" is not duly delimited, the present investigation seeks to specify the type of damage to be taken into account, as well as to incorporate the criterion "conduct of the representatives of the Public Prosecutor's Office" since it is not possible to limit it only to the conduct of the judicial authorities, when the investigation period in the criminal proceeding is directed by the representative of the Public Prosecutor's Office.
