Resumen
El presente informe de relevancia jurídica analizará los fundamentos,
desarrollados por la Sala Especializada de Protección al Consumidor de
INDECOPI, respecto de la reprogramación unilateral de créditos por entidades
financieras en el marco de la normativa sectorial emitida por la Superintendencia
de Banca, Seguros y AFP durante el contexto del estado de emergencia causado
por la pandemia del COVID-19. De tal manera, se abordarán los conceptos de
métodos comerciales coercitivos, deber de idoneidad, deber de información, así
como el marco regulatorio para la modificaciones contractuales unilaterales por
parte de entidades del sistema financiero. Ello, en el marco de lo analizado por
la Sala y los puntos, donde a consideración del presente informe, debió haberse
dado también un enfoque analítico. Posteriormente, se procederá analizar los
requisitos para declarar procedente un recurso de apelación en sede
administrativa, así como el enfoque otorgado a dichos requisitos de procedencia
por parte de la Sala en contraposición de lo señalado por conformaciones
anteriores de la Sala. Sobre este último punto, el presente informe planteará la
posibilidad de la emisión de un precedente de observancia obligatoria, por parte
de la Sala, que recoja el cambio de paradigma sostenido por ésta respecto a la
procedencia de los recursos de apelación.
This report of legal relevance will analyze the grounds, developed by the Specialized Chamber of Consumer Protection of INDECOPI, regarding the unilateral rescheduling of credits by financial entities within the framework of the sectorial regulations issued by the Superintendence of Banking, Insurance and AFP during the context of the state of emergency caused by the COVID-19 pandemic. In this way, the concepts of coercive business methods, duty of suitability, duty of information, as well as the regulatory framework for unilateral contractual modifications by entities of the financial system will be addressed. This, within the framework of what has been analyzed by the Chamber and the points where, in the opinion of this paper, an analytical approach should have been taken. Subsequently, we will proceed to analyze the requirements to declare an administrative appeal admissible, as well as the approach given to such requirements by the Chamber, as opposed to what was stated by previous Chamber's conformations. On this last point, this paper will consider the possibility of the issuance of a precedent of mandatory observance by the Chamber, which reflects the change of paradigm sustained by the Chamber with respect to the admissibility of appeals.
