Resumen
En el presente informe jurídico se analiza la problemática sobre si los servicios
veterinarios que son brindados por Veterinarias Municipales configuran
desarrollo de actividad empresarial del Estado y si, de ser el caso, cumple con
los requisitos que la norma constitucional establece para ello. Para ello, se
precisará en el caso materia de la resolución N° 0081-2019/SDC-INDECOPI, la
cual pretende determinar los criterios para definir los supuestos de actividad
empresarial en materia de servicios veterinarios. Siendo el caso que, la discusión
se centrará en la línea divisoria entre aquello que configura actividad empresarial
y aquello que no, desde la perspectiva de los servicios veterinarios y su relación
con la salud. En esa línea, el presente informe hará una revisión de la normativa,
la doctrina y, especialmente, de la jurisprudencia tanto de la autoridad
administrativa como del supremo intérprete de la Constitución. Adicionalmente,
otra arista de la discusión se centrará en las funciones que son asignadas por la
normativa a los gobiernos locales y, específicamente, a la Municipalidad Distrital
denunciada en el presente caso, a fin de determinar si contaba con las facultades
para brindar los servicios veterinarios materia de imputación. En ese sentido, si
bien la resolución materia de análisis resulta acertada en determinados
aspectos, el presente informe planteará algunas críticas sobre los temas a
abordar.
This legal report analyses the problem of whether the veterinary services provided by Municipal Veterinarians constitute the development of the State's business activity and whether it comply with the requirements that the constitutional norm establishes for this purpose. To this end, resolution No. 0081- 2019/SDC-INDECOPI will be specified in the case, which aims to determine the criteria to define the assumptions of business activity in the field of veterinary services. Being the case, the discussion will focus on the dividing line between what constitutes business activity and what does not, from the perspective of veterinary services and their relationship with health. Along these lines, this report will review the regulations, doctrine, and, especially, the jurisprudence of the administrative authority and the supreme interpreter of the Constitution. Additionally, another aspect of the discussion will focus on the functions assigned by the regulations to local governments and, specifically, to the District Municipality reported in the present case, to determine if it had the powers to provide the veterinary services matter of imputation. In that sense, although the resolution under analysis is correct in certain aspects, this report will raise some criticisms about the issues to be addressed.
