Resumen
La modalidad de Concurso Oferta se utiliza en los contratos de obra pública,
generando controversia respecto a su aplicación debido a que su régimen
jurídico establece como regla general la invariabilidad de la PEO del postor, salvo
excepciones. Para dichas excepciones, la Entidad debe aprobar las prestaciones
adicionales antes de su ejecución. En esta línea, el presente informe jurídico
aborda el Laudo Arbitral del Expediente N° 1908-308-18-CARC-PUCP, en el que
el Consorcio Puentes del Norte es el demandante y Provias Nacional el
demandado, analizando la viabilidad de aprobar un Expediente Técnico
Definitivo que excede el monto contractual bajo la modalidad de un contrato de
Concurso Oferta.
Con el propósito de desarrollar este análisis, primero se explicará la naturaleza
del contrato de Concurso Oferta, así como los deberes, riesgos y
responsabilidades del contratista. Luego, se analizarán los requisitos que debe
cumplir un Expediente Técnico Definitivo para su aprobación. Finalmente, se
evaluará el procedimiento para la aprobación de un Expediente Técnico
Definitivo, incluyendo su aprobación si dicho expediente contiene prestaciones
adicionales. La normativa aplicable al caso es el Decreto Legislativo N° 1017 -
Ley de Contrataciones del Estado y su reglamento, que establece el límite de las
prestaciones adicionales y el procedimiento para su aprobación, debiendo el
Expediente Técnico Definitivo cumplir con estos requisitos para ser aprobado.
The Bid Competition modality is used in public works contracts, generating controversy regarding its application due to the fact that its legal regime establishes as a general rule the invariability of the bidder's economic proposal, except for exceptions. For such exceptions, the Entity must approve the additional services prior to their execution. Along these lines, this legal report addresses the Arbitration Award in Case No. 1908-308-18-CARC-PUCP, in which Consorcio Puentes del Norte is the plaintiff and Provias Nacional is the defendant, analyzing the feasibility of approving a Final Technical File that exceeds the contract amount under the modality of a Tender Offer contract. In order to develop this analysis, first the nature of the Tender Offer contract will be explained, as well as the contractor's duties, risks and responsibilities. Then, the requirements that a Definitive Technical File must meet for its approval will be analyzed. Finally, the procedure for the approval of a Final Technical File will be evaluated, including its approval if such file contains additional services. The regulations applicable to the case are Legislative Decree No. 1017 - State Contracting Law and its regulations, which establish the limit of additional services and the procedure for their approval, and the Final Technical File must comply with these requirements to be approved.
