Abstract
En la presente investigación se realiza una referencia de carácter histórico sobre la Ley N° 28518, Ley sobre Modalidades Formativas Laborales; así como, una descripción de los tipos de las modalidades formativas con la finalidad de realizar un análisis sobre las prácticas pre profesionales en el sector privado.
Asimismo, se evalúan los objetivos de la regulación de esta ley que cuenta con la negativa expresa del componente productivo (laboral) realizada por el legislador, como una decisión política mas no jurídica (primacía de la realidad) a partir de la situación real de prácticas que se mantiene desde hace más de dieciséis años. Esta es una razón suficiente para examinar supuestos de desnaturalización en las prácticas, la situación de los practicantes pre profesionales, y la jurisprudencia.
De igual manera, se realiza una aproximación desde las políticas públicas y sus fases de seguimiento y evaluación. Se valora, además, el fomento del empleo por el Estado como una propuesta política, pero también se establece que no ha tenido un rol activo.
En resumen, se cuestiona y desarrolla la relación entre cifras de precariedad laboral y desempleo juvenil para determinar si se han logrado los objetivos de la norma. Por último, se comparte una propuesta de mejora y alternativa final
In this research, a historical reference to the Law on Labor Training Modalities is made, the types of training modalities contemplated in Law No. 28518 are described in order to carry out an analysis on pre-professional practices in the private sector. Likewise, the objectives of its regulation in our legal system are evaluated to recognize the express refusal (literal) of the productive component (labor) by the legislator as a political decision but not a legal one (primacy of reality) from the real situation of practices that is kept for more than sixteen years. Necessary reason to examine cases of denaturation, as well as the situation of pre-professional practitioners and jurisprudence. In this way, the promotion of employment is valued as a political proposal, which is why it is identified that, although the State has participated, it has not played an active role. For this reason, we carry out an approach from public policies and their monitoring and evaluation phases. Consequently, the relationship between figures of job insecurity and youth unemployment is questioned and developed to determine that the objectives of the regulation have not been achieved. In this way, a proposal for improvement and a final alternative is shared
