Abstract
La presente tesis tiene como finalidad resaltar la importancia de los reclamos dentro
del diseño regulatorio que se recoge en el marco normativo vigente de la actividad
de distribución eléctrica, con la finalidad de que, se advierta la necesidad del
regulador de conseguir que la cantidad de reclamos registrados no sea excesiva, y
que aquellos reclamos que efectivamente son presentados se resuelvan de acuerdo a dicho diseño en la primera instancia, sin que sea necesario que tengan que llegar a una segunda, a cargo del regulador, para que logren ser resueltos correctamente. Para conseguir dichos objetivos es necesario que el regulador aplique los supuestos teóricos de la teoría de los incentivos, referidos específicamente a los problemas de agencia relacionados con situaciones de riesgo moral
The purpose of the following pages is to highlight the importance of claim procedures within the current regulatory framework dictated by the existing legal provisions regarding electricity distribution activities. In this regard, the main goal of our thesis is to create awareness over the need to achieve that the amount of claims filed is not increased and that claims that are effectively filed are resolved in the first instance in accordance with the legal framework above outlined without appealing to a second instance in charge of the regulatory agency. To achieve the above outlined, it is required that the regulatory agency applies the theoretical assumptions of the Incentives Theory which are referred to the agency problems related to situations of moral hazard
