Resumen
El presente informe jurídico trata sobre la Resolución Nº124-2020/CCDINDECOPI
mediante la cual la Comisión de Fiscalización de la Competencia
Desleal declara fundada la infracción a los principios de autenticidad y
adecuación social en el marco de la Ley de Represión de Competencia Deseal
en el ámbito de publicidad comercial por parte del señor Andy Merino Ramírez,
influencer peruano, quien, haciendo uso de sus redes sociales publicita el
aplicativo Picap, plataforma de económica colaborativa que facilita la
intermediación entre conductores de moto lineales con usuarios que desean ser
trasladados.
El objetivo de este informe es dilucidar si el contenido compartido en las redes
sociales por los influencers puede ser publicidad, de este modo, reconocer la
aplicabilidad de la Ley de Represión de Competencia Desleal al caso en
concreto. Asimismo, buscamos estudiar las categorías jurídicas en las que un
influencer llega a ser parte de la relación de difusión de publicidad, a fin de
establecer la asignación de responsabilidad que se lo puede atribuir. Finalmente,
aterrizamos el trabajo realizado un análisis respecto del examen realizado por la
Administración Pública, a fin de concluir si este fue el adecuado en el marco del
procedimiento administrativo sancionador iniciado de oficio en contra del
influencer y en atención a la normativa del sector.
This legal report analyzes the Resolution Nº 124-2020/CCD-INDECOPI by which the Unfair Competition Oversight Commission declares the infringement of the principles of authenticity and social adequacy founded within the framework of the Law for the Repression of Unfair Competition in the field of commercial advertising by Mr. Andy Merino Ramírez, a peruvian influencer, who, using his social networks, advertises the Picap application, a collaborative economic platform that facilitates intermediation between linear motorcycle drivers with users who wish to be transferred. The objective of this report is to determine whether the content shared on social networks by influencers may be advertising, thus recognizing the applicability of the Law for the Repression of Unfair Competition to the specific case. Likewise, we seek to study the legal categories in which an influencer becomes part of the advertising diffusion relationship, in order to establish the assignment of responsibility that can be attributed to it. Finally, we land the work carried out an analysis regarding the examination carried out by the Public Administration, in order to conclude if this was the appropriate one in the framework of the sanctioning administrative procedure initiated ex officio against the influencer and in attention to the regulations of the sector.
