Abstract
El presente trabajo tiene como objetivo analizar si la empresa de
telecomunicaciones Viettel Perú ha incurrido en actos de competencia desleal
en la modalidad de engaño con respecto a la difusión en la cual se promociona
“Planes de Internet ilimitado”. La Comisión de Fiscalización en primera instancia
sanciona a la mencionada empresa de telecomunicaciones por incurrir en actos
de engaño, pues de la información complementaria de las piezas publicitarias se
hace referencia a que en determinado tope de consumo la velocidad se verá
reducida. Frente a ello, la autoridad señala que se estaría desnaturalizando el
mensaje principal, el cual alude necesariamente el proporcionar datos de
descarga y velocidad de manera ilimitada. En esa misma línea, todo anuncio
publicitario para ser analizado debe pasar por un análisis integral y superficial, el
cual no ha sido tomado en cuenta por la Comisión, pues de las piezas
publicitarias emitidas el consumidor no tendría porque no esperar que en
determinado tope de consumo se evidencie una degradación en la velocidad.
Por tanto, se evidencia que las restricciones fueron advertidas de manera
oportuna, lo cual ha de ser conocido por un consumidor razonable, quien en base
a la información proporcionada va a decidir libremente si contratar o no con el
plan ofertado por la empresa de telecomunicaciones.
The purpose of this paper is to analyze whether the telecommunications company Viettel Peru has incurred in acts of unfair competition in the modality of deception with respect to the diffusion in which "Unlimited Internet Plans" are promoted. The Supervisory Commission in the first instance sanctioned the mentioned telecommunications company for engaging in acts of deception, since the complementary information of the advertising pieces makes reference to the fact that at a certain consumption ceiling the speed will be reduced. In view of this, the authority points out that it would be distorting the main message that necessarily alludes to providing download data and speed in an unlimited manner. In the same line, every advertisement to be analyzed must go through the well-known integral and superficial analysis, which has not been taken into account by the Commission, since the consumer would not have to expect that at a certain consumption cap there will be a degradation of the speed. Therefore, it is evident that the restrictions were warned in a timely manner, which must be known by a reasonable consumer who, based on the information provided, will freely decide whether or not to contract the plan offered by the telecommunications company
