Resumen
El presente trabajo tiene como objetivo analizar los principales problemas jurídicos
identificados en la Resolución N° 141-2020-OEFA/TFA-SE, emitida en el marco del
procedimiento sancionador iniciado contra Pluspetrol Norte S.A. por haber incurrido en la
conducta infractora de no realizar la descontaminación efectiva de las áreas impactadas a
consecuencia de una emergencia ambiental producido en el Lote 8. Para el análisis de la
referida resolución se empleó el método de trabajo jurídico para casos complejos, por
cuanto la interpretación de las premisas normativas se hizo a la luz de los principios que
rigen tanto la normativa ambiental como el procedimiento administrativo general. De este
modo, en primer lugar, se arribó a la conclusión de que en primera instancia se contravino
el Principio de debido procedimiento y el Principio de Razonabilidad que rigen el
procedimiento administrativo general. En segundo lugar, que se requiere la actualización
del Programa de Adecuación y Manejo Ambiental (PAMA) del Lote 8 para que este
instrumento de adecuación sea concordante con el Reglamento de la Ley N° 27410, Ley
SEIA, de modo que contenga medidas preventivas ante el riesgo de ocurrencia de
emergencias ambientales.
The objective of this paper is to analyze the main legal problems identified in Resolution No. 141-2020-OEFA/TFA-SE, issued within the framework of administrative sanctioning process against Pluspetrol Norte S.A. for having incurred in the infringement of not carrying out the effective decontamination of the affected areas as a result of an environmental emergency that occurred in Lote 8. For the analysis of the referred resolution, it was used the legal method for complex cases because of the interpretation of the normative provisions was made under the principles of the environmental regulations and the general administrative procedure. Accordingly, in the first conclusion was reached that in the first instance the Principle of due procedure and the Principle of Reasonableness were violated. Secondly, the updating of the Environmental Management and Adaptation Program (PAMA) of Lote 8 is required in order to this adaptation instrument is in coherence with the Law No. 27410, SEIA Law, with the purpose it contains preventive measures against the risk of occurrence of environmental emergencies
