Resumen
En la presente tesis se analizó cómo es que los efectos de la discriminación
remunerativa basada en el género pueden llegar a impactar y ser derivados en las pensiones
de jubilación del Sistema Privado de Pensiones que perciben las personas luego de su vida
activa.
En ese sentido, es preciso enfatizar que se ha estudiado ampliamente la desigualdad
de ingresos de varones y mujeres en el mercado laboral, relacionada estrechamente con la
división sexual del trabajo, la desigual distribución de las responsabilidades familiares,
entre otros factores, concluyéndose que los roles o estereotipos de género son
determinantes para la presencia de discriminación remunerativa en las entidades
empleadoras.
Sin embargo, la discriminación de ingresos que se observa en el mercado laboral
persiste en la percepción de las pensiones de jubilación del Sistema Privado de Pensiones.
Pues, como sabemos, el Sistema Privado de Pensiones está fundado bajo un modelo de
contribuciones o aportes ligados a las remuneraciones. Entonces, si tenemos en cuenta que
el mercado laboral presenta discriminación remunerativa, es posible que dicha
discriminación se vea reflejada luego en la percepción de las pensiones de jubilación; en
otras palabras, la discriminación de ingresos de varones y mujeres en su vida laboral activa
se mantiene en su vida pasiva.
Bajo esa perspectiva de discriminación de ingresos derivada en las pensiones de
jubilación del Sistema Privado de Pensiones, se plantearon diversas medidas para brindar
un trato equitativo en las pensiones de jubilación.
This thesis analyzed how the effects of gender-based remuneration discrimination can impact and be derived in retirement pensions from the Private Pension System that people receive after their active life. In this sense, it must be emphasized that the inequality of income of men and women in the labor market has been extensively studied, closely related to the Sexual Division of Labor (SDL), the unequal distribution of family responsibilities, among other factors, concluding that gender roles or stereotypes are decisive for the presence of remunerative discrimination in employing entities. However, the income discrimination observed in the labor market persists in the perception of retirement pensions from the Private Pension System. Well, as we know, the Private Pension System is founded on a model of contributions or contributions linked to remuneration. Consequently, if we consider that the labor market presents remunerative discrimination, such discrimination may later be reflected in the perception of retirement pensions; in other words, the discrimination of income of men and women in their active working life is maintained in their passive life. Under this perspective of income discrimination derived from retirement pensions of the Private Pension System, various measures were proposed to provide equitable treatment in retirement pensions.
