Abstract
En el presente informe se realiza un análisis jurídico de los argumentos y la
decisión adoptada por la Sala de Protección del Consumidor en la Resolución
3341-2023/SPC-INDECOPI, correspondiente a la denuncia interpuesta por la
Asociación de Consumidores Nouvelle Défense contra Conecta Market Place
S.A.C por presuntamente haber infringido su deber de información al no detallar
características como la memoria ram, la memoria de almacenamiento, el sistema
operativo, el procesador y el año de fabricación de los Smart TV que ofertaba
dentro de su página web. Este trabajo estudia qué se considera como
información relevante dentro del Código de Protección y Defensa del
Consumidor, a la luz de jurisprudencia y doctrina relevante. Asimismo, se evalúa
el alcance del principio de predictibilidad en el cambio de criterio de las
resoluciones administrativas. Finalmente, se proponen algunas
recomendaciones dirigidas al Instituto Nacional de Defensa de la Competencia y
de la Protección de la Propiedad Intelectual – INDECOPI respecto de qué se
debe considerar información relevante dentro del mercado de adquisición de los
Smart TV, atendiendo a las nuevas tecnologías y sugiere una mejora dentro de
las motivaciones del cambio de criterio para evitar resoluciones que puedan
afectar el principio de predictibilidad en los procedimientos administrativos.
In this report, a legal analysis is conducted on the arguments and decision rendered by the Consumer Protection Chamber in Resolution 3341-2023/SPCINDECOPI, pertaining to the complaint filed by the Association of Consumers Nouvelle Défense against Conecta Market Place S.A. The complaint alleges that Conecta Market Place S.A.C violated its duty to inform by failing to specify details such as RAM, storage capacity, operating system, processor, and manufacturing year of the Smart TVs offered on its website. This study investigates what constitutes relevant information under the Consumer Protection and Defense Code, considering pertinent jurisprudence and doctrine. Additionally, it assesses the extent of the principle of predictability in the alteration of criteria in administrative resolutions. Finally, the report proposes several recommendations to the National Institute for the Defense of Competition and Protection of Intellectual Property (INDECOPI) regarding what should be deemed relevant information in the Smart TV market, in light of new technologies. It also suggests improvements in the rationale for changes in criteria to prevent resolutions that could undermine the principle of predictability in administrative procedures.
