Informe jurídico sobre la sentencia y auto del Tribunal Constitucional, en el marco del expediente N°04769-2017-PA/TC: Un caso de “retorno” de un antiguo propietario expropiado por la Reforma Agraria de 1969

Resumen
El caso que se analiza está relacionado con una expropiación realizada en 1972
en el marco del Decreto Ley N°17716 o también llamada Ley de Reforma Agraria.
Este antiguo propietario y su hijo interponen una demanda de amparo que llega
al Tribunal Constitucional, buscando restituir su derecho de propiedad.
Asimismo, se realizó un enfoque no solo jurídico, sino también desde la
perspectiva histórica y social más amplia del contexto de los años 50´s y 60´s en
el Perú, en el cual se producen masivas recuperaciones de tierras de parte de
comunidades y del campesinado. Finalmente, las principales normas utilizadas
son la Constitución Política del Perú de 1933, así como el Decreto Ley N°17716
y sus diversos antecedentes normativos.
The case being analyzed is related to an expropriation carried out in 1972 within the framework of Decree Law No. 17716 or also called the Agrarian Reform Law. This former owner and his son filed a claim that reached the Constitutional Court with the objective to restore their right to property. Likewise, an approach was made not only legal, but also from the broader historical and social perspective of the context of the 50's and 60's in Peru, in which massive land recuperations were produced by communities and the peasantry. Finally, the main norms used are the Political Constitution of Peru of 1933, as well as Decree Law No. 17716 and its various regulatory backgrounds.
