Abstract
En el presente trabajo de investigación se pretende demostrar la necesidad de
adoptar el criterio de responsabilidad subjetiva en el régimen sancionador de las
contrataciones del Estado. Como se verá en el desarrollo del referido análisis, el
criterio de responsabilidad subjetiva es mucho más garantista de los derechos
de los administrados, en comparación con su contrapartida, la responsabilidad
objetiva. Sin perjuicio de ello, es importante señalar que no aspiramos a sugerir
que la responsabilidad subjetiva prime en todos los tipos infractores establecidos
en la normativa en materia de contrataciones del Estado; sino, a través del
estudio de las tendencias adoptadas por el Tribunal de Contrataciones del
Estado en sus resoluciones emitidas durante el primer trimestre del año 2020,
establecer, qué tipo de régimen es el más conveniente para cada infracción,
desde una perspectiva de eficiencia. Ello debido a que, si bien el criterio de
responsabilidad subjetiva es el más garantista de derechos, importa también
tener claro si conviene o no aplicarlo a ciertos tipos infractores o si es que su
empleo es irrelevante para la determinación de responsabilidad de los
administrados.
In the following research aims to demonstrate the need to adopt the criterion of subjective liability in the sanctioning regime of State Contracting. As will be seen in the development of the aforementioned analysis, the criterion of subjective liability is much more guaranteeing of the rights of the administered, in comparison with its counterpart, objective liability. Notwithstanding this, it is important to point out that we do not aspire to suggest that subjective liability prevails in all types of infringement established in the regulations on State Contracting; but, through the study of the trends adopted by the State Contracting Court in its resolutions issued during the first quarter of 2020, establish what type of regime is the most convenient for each infraction, from an efficiency perspective. This is due to the fact that, although the criterion of subjective liability is the most guarantor of rights, it is also important to be clear about whether or not it should be applied to certain types of offenders or whether its use is irrelevant for determining the liability of the administered.
