Resumen
El presente informe jurídico analiza la Sentencia de la Corte Superior de Justicia,
recaída en el expediente Nº 06323-2021–0-1801-JR-DC-09, respecto a la
demanda de amparo interpuesta por el ciudadano Ricardo Morán contra la
RENIEC. Puesto que, este último organismo del Estado determinó que para la
inscripción del acta de nacimiento de sus hijos, quienes nacieron a través de la
gestación subrogada transfronteriza, era requisito necesario el nombre de la
madre biológica de los niños. Dicha decisión fue materia de discusión en la
instancia judicial y se determinó que no existía “legislación positiva que justifique
dichos actos”. Por lo tanto, era imprescindible la información que estaba
requiriendo la RENIEC. Sin embargo, dicha decisión, no consideró tres hechos
relevantes, primero, que el artículo 7 de la Ley General de Salud establece que
el acceso a las técnicas de reproducción asistida es un derecho para todo
peruano. Segundo, los niños en cuestión fueron procreados a través de la
ovodonación. Tercero, que dicho ciudadano peruano cuenta con la exclusiva
patria potestad de sus hijos, establecida a través de una sentencia extranjera.
En ese sentido, se analizará los argumentos del juez en base a la legislación,
doctrina y jurisprudencia vigente para demostrar la afectación a los derechos de
fundar y pertenecer a una familia. El quebrantamiento de los derechos
reproductivos así como el de igualdad y no discriminación por razón de sexo al
ciudadano Ricardo Morán. Por último, la vulneración del derecho a la identidad
y otros derechos civiles de los niños.
This legal report analyzes the Judgment of the Superior Court of Justice, relapsed in file Nº 06323-2021-0-1801-JR-DC-09, regarding the demand for protection filed by the citizen Ricardo Morán against the RENIEC. Since the latter state body demanded that for the registration of the birth certificate of their children, who were born through cross-border surrogacy, it was demanding to have the name of the biological mother of the children. This decisión was subject of discusión in the judicial instance and it was determined that there was not “positive legislation that justifies said acts”. Therefore, the information demanded by the RENIEC was essential. However, said decisión did not considered three relevant facts, first, that the article 7 of the General Health Law establishes that the access to assisted reproduction techniques is a right for all peruvian person. Second, the children were procreated through egg donation. Third, that said peruvian citizen has the exclusive parental authority of his children, established by a foreign sentence. In this sense, the arguments of the judge will be analyzed based on the current legislation, doctrine and jurisprudence, to demonstrate the affectation of the rights of founding and belonging to a family. The violation of the reproductive rights, as well as equality and non-discrimination based on sex to the citizen Ricardo Morán. Finally, the violation of the right of identity and other civil rights of the children.
