Resumen
La presente investigación versa sobre la penalización del aborto en el ordenamiento jurídico
peruano, analizada desde un enfoque feminista para determinar el impacto de dicha regulación en
el derecho a la salud. En ese sentido, se revisará el aborto a nivel conceptual y material, para lo
cual se recurrirá principalmente a los aportes de la Organización Mundial de la Salud; acto
seguido, se presentará y explicará la importancia de las herramientas del feminismo, siendo la
principal el enfoque feminista; luego, se detallarán los extremos más relevantes de su marco
jurídico, como su aspecto teórico, normativo y jurisprudencial, a nivel nacional e interamericano.
Siguiendo ese orden, se empleará el feminismo para analizar el desarrollo del derecho a la salud
en casos de aborto, lo que nos permitirá respaldar o desestimar la hipótesis elaborada, la cual
propone que la ilegalidad del aborto incide negativamente en la realización del derecho a la salud
de las mujeres peruanas, en la medida que la penalización de dicha práctica las perjudica al negar
o restringir el uso, goce y/o disfrute del derecho del cual son titulares.
The present investigation focuses on the penalization of abortion in the Peruvian legal system, analyzed through a feminist lens to ascertain the impact of this regulation on the right to health. In this regard, abortion will be explored conceptually and materially, primarily drawing on contributions from the World’ Health Organization; then, feminism and its tools will be portraited; later on, the most relevant aspects of its legal framework such as theoretical, normative, and jurisprudential facets, nationally and international, will be outlined. Following this order, feminism will be employed to analyze the development of the right to health in abortion cases, enabling us to either support or challenge the formulated hypothesis which suggests that the illegality of abortion adversely impacts the realization of the right to health for Peruvian women, as the penalization of this practice harms them by denying or restricting the use, enjoyment and/or fulfillment of the right they hold.
