Resumen
El presente informe versa sobre la controversia que resolvió el Instituto Nacional de Defensa
de la Competencia y Propiedad Intelectual (en adelante, INDECOPI) a propósito de la
disconformidad por parte de los ingenieros de nacionalidad extranjera, debido a que el Colegio
de Ingenieros del Perú había impuesto el cobro ascendente a $/. 2 000,00 (dos mil dólares), para
la obtención de la colegiatura. Además, habría generado un trato diferenciado entre ingenieros
nacionales y extranjeros al establecer dos procedimientos de colegiación: ordinario y temporal,
en el cual los ingenieros extranjeros solo podían optar por la colegiatura temporal.
El primer objetivo ha sido determinar la naturaleza jurídica de los Colegios Profesionales, con
énfasis en el Colegio de Ingenieros del Perú. También, se determinará cuáles son los criterios
que se habría adoptado para considerar a una entidad como parte de la Administración Pública,
a fin de indicar si el Colegio de Ingenieros del Perú forma parte de las entidades de la
Administración Pública.
Al respecto, se ha concluido que el Colegio de Ingenieros del Perú posee una naturaleza jurídica
mixta porque ejerce función pública y privada. Por ende, en tanto, ejerce función administrativa
su actuación debe ser acorde con lo regulado por la Ley de Procedimiento Administrativo
General.
This report deals with the controversy resolved by the National Institute for the Defense of Competition and Intellectual Property (INDECOPI) regarding the disagreement on the part of the engineers of foreign nationality, since the Peruvian College of Engineers had tax the charge amounting to $ /. 2,000.00 (two thousand dollars), to obtain tuition. In addition, it would have generated a differentiated treatment between national and foreign engineers by establishing two registration procedures: ordinary and temporary, in which foreign engineers could only opt for temporary registration. The first objective has been to determine the legal nature of the Professional Associations, with emphasis on the College of Engineers of Peru. Also, it will be determined what are the criteria that would have been adopted to consider an entity as part of the Public Administration, to indicate if the College of Engineers of Peru is part of the entities of the Public Administration. In this regard, it has been concluded that the College of Engineers of Peru has a mixed legal nature because it exercises a public and private function. Therefore, while exercising an administrative function, its performance must be in accordance with what is regulated by the General Administrative Procedure Law.
