Resumen
El presente informe tiene como fin analizar la Resolución N° 9 emitida por la
Primera Sala Civil Subespecialidad Comercial de la Corte Superior de Justicia
de Lima recaída en el Exp. N°00338-2021-0-1817-SP-CO-01. En dicha
resolución se resolvió declarar fundada la demanda de nulidad del laudo arbitral,
emitido el 25 de mayo de 2021, interpuesta por la Municipalidad Distrital de
Miraflores. Dicho laudo fue emitido a raíz del proceso arbitral desarrollado entre
la Municipalidad mencionada y Petramas S.A.C. La resolución señalada tuvo
como objeto determinar si el laudo cuestionado tuvo una aparente motivación
cuando el tribunal arbitral resolvió la excepción de caducidad planteada por la
Entidad.
El presente informe tiene como finalidad realizar un análisis respecto al
tratamiento de la excepción de caducidad dentro de la normativa peruana y cómo
ello se relaciona con el principio de competence - competence y el control judicial
de los laudos arbitrales. Asimismo, se analizará la motivación aparente y cuál es
el estándar de motivación exigido en los laudos arbitrales.
The purpose of this report is to analyze Resolution Nº 9, issued by the First Civil Chamber of the Commerce subspecialty of the Supreme Court of Lima in case Nº 00338-2021-0-1817-SP-CO-01. With this decision, it was decided to declare founded the appeal for annulment of the arbitration award of May 25, 2021, issued by the Municipal Government of the District of Miraflores. This ruling is the result of an arbitration procedure established between the aforementioned municipality and Petramas S.A.C. The resolution in question aimed to determine whether the challenged award had apparent motivation when the arbitral tribunal ruled on the lapse of claim defense raised by the Entity. The purpose of this report is to conduct an analysis regarding the treatment of the exception of lapse within Peruvian regulations and how this relates to the principle of competence-competence and judicial review of arbitral awards. Furthermore, the report will analyze apparent motivation and what the standard of motivation required in arbitral awards is.
