Resumen
El informe realiza un análisis crítico sobre la resolución 971-2019-SUNARP-TRL.
El Tribunal Registral resolvió que procede la inscripción registral de la
rectificación de la calidad del bien por un matrimonio del mismo sexo celebrado
en el extranjero.
Se evidencia un conflicto jurídico puesto que el matrimonio entre personas del
mismo sexo no se encuentra regulado en el ordenamiento jurídico. El problema
principal se presenta en la interpretación que el órgano de SUNARP desarrolla
sobre el contenido del concepto “orden público internacional”. Se propone una
interpretación diferente del término con sustento en la doctrina mayoritaria, y
realizar un análisis diferente en el caso concreto, en la función de la calificación
registral. Asimismo, se analiza la calificación registral en el procedimiento
registral, encaminar los alcances de su ejercicio y competencia.
Este informe no comparte la postura del Tribunal Registral en el sustento de los
argumentos ni lo resuelto. El desarrollo del informe es en el marco de un método
de investigación dogmático simple. Se ha realizado un análisis en torno al
espacio de normas, doctrina y jurisprudencia. El resultado del estudio es que, en
el caso concreto, la norma extranjera transgrede los principios esenciales del
ordenamiento jurídico peruano. Por lo tanto, no resulta inscribible.
The report makes a critical analysis of resolution 971-2019-SUNARP-TR-L. The Registry Court resolved that the registration of the rectification of the quality of the property by a same-sex marriage celebrated abroad is appropriate. A legal conflict is evident since marriage between persons of the same sex is not regulated in the legal system. The main problem arises in the interpretation that the SUNARP body develops on the content of the concept "international public order". A different interpretation of the term is proposed, based on the majority doctrine, and a different analysis is made in the specific case, in the function of the registry qualification. Likewise, the registry appraisal is analyzed in the registry procedure, to determine the scope of its exercise and competence. This report does not share the position of the Registry Court in the support of the arguments nor what was resolved. The development of the report is within the framework of a simple dogmatic research method. An analysis has been made around the space of norms, doctrine and jurisprudence. The result of the study is that, in the specific case, the foreign norm transgresses the essential principles of the Peruvian legal system. Therefore, it is not registrable.
