Resumen
El informe jurídico analiza la Sentencia 302/2023 – Caso de los
parámetros urbanísticos II, del Tribunal Constitucional del Perú, que aborda el
conflicto competencial entre los Gobiernos Locales, representados por la
Municipalidad Metropolitana de Lima y la Municipalidad Distrital de Barranco, y
el Poder Ejecutivo, específicamente el Ministerio de Vivienda, Construcción y
Saneamiento (MVCS). El principal foco del análisis se centra en cómo esta
sentencia afecta el derecho fundamental de acceso a la vivienda digna y la
seguridad jurídica de los tenedores de títulos habilitantes en el marco del
Reglamento Especial emitido por el MVCS.
El informe examina tanto los antecedentes como los aspectos legales, sociales
y urbanísticos involucrados, destacando el impacto de la sentencia en la
regulación de la Vivienda de Interés Social (VIS). También aborda las
implicaciones que este fallo podría tener en el desarrollo urbano y en la
