Abstract
La Resolución N.°1723-2023/SPC-INDECOPI se centra en el proceso
administrativo sancionador iniciado por ACUREA contra Comercial Mont S.A.C.
y su gerente general, el señor Mont, por presuntas cláusulas abusivas en los
Términos y Condiciones del portal web de Platanitos, contraviniendo el Código
de Protección y Defensa del Consumidor. El análisis crítico de este caso se
enfoca en las decisiones adoptadas por la Sala Especializada en Protección al
Consumidor de INDECOPI, específicamente en la evaluación de las cláusulas
denunciadas y los criterios utilizados para determinar si la conducta infractora
fue subsanada y la responsabilidad del gerente general. Se coincide con la Sala
en la declaración de algunas cláusulas como abusivas mientras que otras no lo
fueron. Sin embargo, se cuestiona la adecuación de la resolución emitida,
argumentando que hubo errores en la aplicación de los criterios legales
pertinentes. Esta postura crítica subraya la importancia de un examen detallado
y preciso en la protección de los derechos del consumidor y la correcta aplicación
de las normativas vigentes en materia de defensa del consumidor y
