Resumen
El presente informe busca analizar las sanciones impuestas por la Sala
Especializada en Protección al Consumidor del Instituto Nacional de Defensa de
la Competencia y de la Protección de la Propiedad Intelectual (Indecopi) al Banco
GNB Perú S.A. por haber infringido los derechos de los consumidores a no ser
discriminados y a recibir productos y servicios idóneos. Mediante la revisión de
legislación, doctrina y jurisprudencia relevante en relación al caso, se abordan
diversos aspectos y problemáticas de la resolución emitida por el superior
jerárquico, a fin de determinar si las conductas resultaban atribuibles a la entidad
financiera y si, en consecuencia, correspondía imponer las sanciones. Se inicia
con un desarrollo sobre la competencia del Indecopi; luego se tratan los
conceptos de discriminación, idoneidad, consumidor financiero, y tarjetas de
crédito, entre otros; y se finaliza con una mirada a las sanciones y medidas
correctivas adoptadas. El Indecopi es la entidad competente para investigar,
seguir y sancionar las conductas analizadas en el pronunciamiento materia de
análisis. Además, es posible concluir que el Banco incurrió en prácticas
discriminatorias por razones etarias e infringió su deber de idoneidad en función
de la información puesta a disposición de los consumidores con respecto a
algunos de sus productos financieros. Finalmente, se evidencia que las multas y
acciones correctivas de la autoridad de consumo no han logrado necesariamente
un cambio real en el comportamiento del Banco, por lo que queda espacio para
mejorar en este tipo de procedimientos, a fin de lograr una debida protección del
consumidor.
This report seeks to analyze the sanctions imposed by the Specialized Consumer Protection Chamber of the National Institute for the Defense of Competition and Protection of Intellectual Property (Indecopi) on Banco GNB Perú S.A. for having infringed the rights of consumers not to be discriminated against and to receive suitable products and services. By reviewing relevant legislation, doctrine and jurisprudence in relation to the case, various aspects and problems of the resolution issued by the hierarchical superior are addressed, in order to determine whether the conduct was attributable to the financial institution and whether, consequently, it was appropriate to impose sanctions. It begins with a development of the competence of Indecopi; then the concepts of discrimination, suitability, financial consumer, and credit cards, among others, are discussed; and ends with a look at the sanctions and corrective measures adopted. Indecopi is the competent entity to investigate, follow up and sanction the conducts analyzed in the pronouncement under analysis. In addition, it is possible to conclude that the Bank incurred in discriminatory practices based on age and breached its duty of suitability based on the information made available to consumers with respect to some of its financial products. Finally, it is evident that the fines and corrective actions of the consumer authority have not necessarily achieved a real change in the bank's behavior, so there is still room for improvement in this type of procedures, in order to achieve proper consumer protection.
