Resumen
El presente trabajo aborda el estudio de la fuerza vinculante de los estándares de la
Corte Interamericana de Derechos Humanos, con la finalidad de determinar si tienen
fuerza vinculante para los tribunales nacionales de Estados que no han sido condenados
en los casos donde se establecieron. Para ello, se establece el concepto de estándar,
luego se analizan los diferentes argumentos esgrimidos en torno a su fuerza vinculante,
tanto los desarrollados por la propia Corte Interamericana como por la doctrina
especializada. De ahí se desarrolla, desde una perspectiva general, la recepción de los
estándares interamericanos por las cortes nacionales para, finalmente, analizar la
recepción y seguimiento del estándar sobre la invalidez de las leyes de auto-amnistía.
Con el análisis de casos de la Corte Interamericana que establecen ese estándar y de las
cortes de Argentina, Uruguay y Colombia que los reciben y utilizan se arriba a la
conclusión que su fuerza vinculante depende, en gran medida, del uso que le dan las
cortes nacionales.
The present work deals with the study of the binding force of the standards of the Inter- American Court of Human Rights, with the purpose of determining if they have binding force for the national courts of States that have not been condemned in the cases where they were established. To this end, the concept of a standard is established, then the different arguments put forward regarding its binding force are analyzed, both those developed by the Inter-American Court itself and by the specialized doctrine. From there, from a general perspective, the reception of the inter-American standards by the national courts is developed to, finally, analyze the reception and follow-up of the standard on the invalidity of the self-amnesty laws. With the analysis of cases of the Inter-American Court that establish that standard and of the courts of Argentina, Uruguay and Colombia that receive and use them, it is concluded that their binding force depends, to a large extent, on the use of the national courts.
