El principio de suplencia de queja deficiente y el Proceso Civil: En busca de una mayor protección de los derechos fundamentales en controversias privadas

Resumen
El presente artículo versa sobre el análisis de la aplicación de la suplencia de queja
deficiente; como un principio orientador, garantista, de naturaleza procesal, e implícito
en la actualidad en el ordenamiento jurídico procesal constitucional peruano. Principio
que configura una facultad y una obligación del Juez constitucional de suplir la
deficiencia en la que hubiese incurrido la parte actora de un proceso, en la determinación
del derecho subjetivo vulnerado. Trabajo de investigación, en el que determinaremos a
través de un análisis: histórico, normativo, comparado y jurisprudencial; el desarrollo y
configuración del citado principio en nuestro ordenamiento procesal. Para luego proceder
a un análisis de la viabilidad de la aplicación de la suplencia de queja deficiente en el
ámbito del proceso civil; siendo el objetivo de la presente investigación: determinar la
viabilidad de su aplicación en los procesos civiles. Desarrollándose la investigación bajo
el enfoque del método cualitativo, empleándose la observación documental como
instrumento de la presente investigación explicativa. Radicando nuestra conclusión, en el
sentido que este principio es perfectamente aplicable a otros campos del derecho procesal
civil, además de los que se describen en el presente trabajo; a fin de brindar una efectiva
tutela procesal a los derechos de naturaleza civil, por el que se faculta al Juez a precisar
el derecho conculcado, siempre que este se derive de los hechos expuestos por las partes
procesales. Debiendo regularse en forma taxativa la aplicación de la suplencia de queja
deficiente, a fin de brindar un marco normativo adecuado para su aplicación.
This artiche deals with the analysis of the application of the substitution of deficient complaint; as a guiding, guaranteeing principle, of a procedural nature, and currently implicit in the peruvian constitutional procedural law system. Principle that configures a power and obligation of the constitutional judge to make up for the deficiency in which the plaintiff of a process would have incurred, in determining the subjective rigth violated. Research work, in wich we’ll determine through an analysis: historical, normative, comparative and in the case law; the development and configuration of the aforementioned principle in our procedural order. To then proceed to an analysis of the feasibility of applying the substitution of deficient complaint in the field of civil proceedings; being the objective of the present investigation: to determine the viability of 3 its application in civil proceedings. Developing the research under the qualitative method approach, using documentary observation as an instrument of the present explanatory research. Establishing our inference, in the sense that this principle is perfectly applicable to other fiels of civil procedural law, in addition to those described in the present work; in order to provide an effective procedural protection for civil rights, by which the judge is empowered to specify the violated right, provide that it is derived from the facts presented by the procedural parties. The applicatipn of the substitution of deficient complaint must be strictly regulated, in order to provide an adequate regulatory framework for its apllication.
