Informe jurídico sobre la sentencia del Tribunal Constitucional recaída en el expediente N° 001-2012-PI/TC: caso de la Ordenanza Regional N°036-2011-GR.CAJ-CR que declaró inviable la ejecución del Proyecto Minero Conga

Resumen
El estallido del conflicto social, ambiental y cultural motivado por el posible
desarrollo del Proyecto Minero “Conga” atrajo las miradas de todo el país y del
mundo, debido a la inversión proyectada de 4,800 millones de dólares, por parte
de la Minera Yanacocha. Mientras el Gobierno Peruano, liderado por el
Presidente Ollanta Humala Tasso, intentaba apaciguar el conflicto y llevar a cabo
el proyecto; por su parte, el Gobierno Regional de Cajamarca, a través de su
Presidente Regional, Gregorio Santos Guerrero, recogió los pedidos de la
población que se oponía a la desaparición de sus lagunas, a través de la emisión
de la Ordenanza Regional N° 036 – 2011 – GR.CAJ-CR, la cual, declaraba
inviable “Conga”. El Fiscal de la Nación interpuso una Demanda de
Inconstitucionalidad en contra de la ordenanza, la cual, daba la oportunidad al
Tribunal Constitucional Peruano para emitir una Sentencia que resuelva el
conflicto; sin embargo, el máximo intérprete de la Constitución decidió, de
manera apresurada, no pronunciarse sobre el EIA de Conga e invisibilizar a las
Comunidades Campesinas y Rondas Campesinas existentes en el área de
influencia del proyecto minero, para evitar pronunciarse sobre temas como el
Convenio 169 de la Organización Internacional del Trabajo o la aplicación de la
Consulta Previa.
The outbreak of social, environmental and cultural conflict motivated by the possible development of the Conga Mining Project attracted the attention of the whole country and the world, due to the projected investment of 4,800 million dollars, by the Yanacocha Mining. While the Peruvian Government, led by President Ollanta Humala Tasso, tried to defuse the conflict and carry through the project; on the other hand, the Regional Government of Cajamarca, through its Regional President, Gregorio Santos Guerrero, collected the requests of the population that opposed the disappearance of its lagoons, through the release of Regional Ordinance N° 036 - 2011 - GR.CAJ-CR, which declared "Conga" unfeasible. Unexpectedly, the Attorney General of the Nation filed a complaint of unconstitutionality against the ordinance, which gave the opportunity to the Peruvian Constitutional Court to issue a judgment to resolve the conflict; however, the chief interpreter of the Constitution decided, hastily, not to pronounce on the Environmental Impact Assessment of Conga and to make invisible the existing Peasant Communities and Peasant Rounds in the area of influence of the mining project, to avoid pronouncing on issues such as Convention 169 of the International Labour Organization or the application of Prior Consultation.
