Abstract
El presente trabajo tiene como objetivo abordar el razonamiento utilizado por la Sala de
Protección al Consumidor cuando resolvió el caso visto en la Resolución N.° 2135-
2012/SC2-INDECOPI, la misma que marcó un antes y un después en el tratamiento de
los casos inherentes a la discriminación por discapacidad; estableciendo así, bajo el
análisis de conceptos como los de libertad de empresa y contratación, selección de
riesgo y discapacidad, si el pronunciamiento de la Sala fue el más idóneo, o si por el
contrario el Tribunal emitió un pronunciamiento sesgado al afirmar que se había
configurado un acto de discriminación contra la hija del denunciante, al no haber
accedido Rímac Seguros a afiliarla al seguro Red Salud por tener esta Síndrome de
Down, el mismo que según la empresa aseguradora no era un riesgo asegurable dada
su alta siniestralidad.
The objective of this paper is to analyze the reasoning used by the Tribunal of INDECOPI when it resolved the case seen by the Resolution N.° 2135-2012/SC2-INDECOPI, the one that marked a breaking point in how the cases inherent to disability discrimination were solved. With that purpose we will approach to concepts such as freedom of enterprise and contracting, risk selection and disability, so we can be able to determine if the reasoning of the Tribunal was the most appropriate, or if, on the other side, the Tribunal, emited a resolution based on preconceived ideas, leading them to afirm that the insurer, Rímac Seguros, descriminated the daugther of the denouncing, as she has down’s syndrome, because the Enterprise considered that one was an uninsurable risk for its high accidente rate.
