Abstract
El estudio se centra en la implementación de programas de cumplimiento como mecanismo
preventivo en entidades públicas para reducir la corrupción y garantizar la legalidad en la
contratación pública, mediante estándares internacionales y reformas legales.
Se destaca la importancia de fortalecer el sistema de control y promover la prevención del
delito y la irregularidad administrativa. La falta de prevención en la legislación penal actual, a
pesar de las severas sanciones, especialmente en casos de corrupción durante estados de
emergencia, es objeto de investigación. Se propone la implementación de un sistema integral de
cumplimiento basado en la norma ISO37301:2021, con estándares internacionales, para reducir la
corrupción y garantizar que los órganos de control realicen su trabajo de manera efectiva.
El sistema de cumplimiento permitirá a las entidades públicas diseñar programas de
cumplimiento basados en estándares internacionales para evitar irregularidades y actos de
corrupción en la contratación pública. Se busca una reforma legal que equilibre la flexibilidad de
los procesos de contratación en situaciones de emergencia con una supervisión efectiva. La
certificación de programas de cumplimiento será estándar para todas las entidades públicas,
evitando discrecionalidades y facilitando el control inesperado y procedimental por parte de la
Contraloría para prevenir irregularidades administrativas y delitos funcionales.
The study focuses on the implementation of compliance programs as a preventive mechanism in public entities to reduce corruption and guarantee legality in public procurement, through international standards and legal reforms. The importance of strengthening the control system and promoting the prevention of crime and administrative irregularity is highlighted. The lack of prevention in current criminal legislation, despite severe sanctions, especially in cases of corruption during states of emergency, is the subject of investigation. The implementation of a comprehensive compliance system based on the ISO37301:2021 standard, with international standards, is proposed to reduce corruption and guarantee that control bodies carry out their work effectively. The compliance system will allow public entities to design compliance programs based on international standards to avoid irregularities and acts of corruption in public procurement. Legal reform is sought that balances the flexibility of contracting processes in emergency situations with effective supervision. The certification of compliance programs will be standard for all public entities, avoiding discretions and facilitating unexpected and procedural control by the Comptroller's Office to prevent administrative irregularities and functional crimes.
