Abstract
El presente informe aborda el procedimiento administrativo sancionador seguido por
OSITRAN contra Ferrocarril Trasandino S.A, por la imposición de una penalidad contractual,
en el marco de la ejecución del contrato de Concesión de la Administración de los
Ferrocarriles Centro, Sur y Sur- Oriente. Los hechos inician cuando el operador de servicios
de transporte ferroviario adquiere seis coches nuevos destinados al servicio de lujo Hiram
Bingham, los cuales circulan en la vía férrea sin la autorización del Ministerio de Transportes
y Comunicaciones.
A partir de la Resolución de Consejo Directivo N° 041-2004-CD/OSITRAN, se analizan los
límites de la colaboración público – privada y el alcance de la cláusula 7.5 del contrato de
concesión, la cual impone al concesionario la obligación de supervisar que el operador de
servicios de transporte ferroviario cumpla con las Leyes Aplicables. Así, se determina que el
contrato de concesión no trasfiere la facultad de fiscalización al concesionario, por el
contrario, impone la realización de la actividad material de verificación.
Asimismo, se abarca el tratamiento jurídico de las penalidades contractuales bajo el marco
de lo establecido en el contrato de concesión. A partir de ello, se evalúa el ejercicio de la
potestad punitiva de OSITRAN para la imposición de penalidades contractuales mediante un
procedimiento administrativo sancionador. De esta forma, se expone la desnaturalización de
las cláusulas penales y del poder punitivo del Estado.
This report addresses the administrative sanctioning procedure followed by OSITRAN against Ferrocarril Trasandino S.A., for the imposition of a contractual penalty, within the framework of the execution of the Concession Contract for the Administration of the Central, South and South-East Railroads. The facts begin when the railroad transportation services operator acquires six new cars destined for the Hiram Bingham luxury service, which circulate on the railroad without the authorization of the Ministry of Transportation and Communications.. Based on Board of Directors Resolution No. 041-2004-CD/OSITRAN, the limits of the publicprivate partnership and the scope of clause 7.5 of the concession contract, which imposes on the concessionaire the obligation to supervise that the railroad transportation services operator complies with the Applicable Laws, are analyzed. Thus, it is determined that the concession contract does not transfer the power of supervision to the concessionaire, on the contrary, it imposes the performance of the material activity of verification. Likewise, the legal treatment of contractual penalties is covered under the framework established in the concession contract. Based on this, the exercise of OSITRAN's punitive power to impose contractual penalties through an administrative sanctioning procedure is evaluated. In this way, the distortion of the penal clauses and the punitive power of the State is exposed.
