¿Es posible la inaplicación con alcance general de Barreras Burocráticas carentes de razonabilidad?

Resumen
El derecho constitucional a la libre iniciativa privada, libertad de empresa y la libre
competencia no deben contravenir el interés público; por ello, es necesario que la
administración pública establezca medidas como exigencias, prohibiciones, cobros legales
y razonables, a fin de proteger el interés general de la sociedad. Sin embargo, las entidades
de las administraciones no realizan un adecuado análisis de impacto regulatorio, por lo que
los agentes económicos se ven afectados en cuanto al acceso y permanencia en el mercado.
El Decreto Legislativo N°1256 fue publicado a fines del 2016 y la finalidad de esta norma fue
fortalecer las competencias del Indecopi. Una de las novedades fue el alcance de la
inaplicación con efectos generales de aquellas Resoluciones que declaran ilegales las
Barreras Burocráticas materializadas en disposiciones administrativas; sin embargo, en la
exposición de motivos, no se evidencia una justificación adecuada respecto a la exclusión
de las Barreras carentes de razonabilidad, pues en estas últimas los efectos recaerán,
únicamente, a la parte denunciante y no a los demás que se vean afectados por la medida
cuestionada.
En este sentido, el presente informe tiene como finalidad demostrar y proponer la
viabilidad de la inaplicación con efectos generales en las Barreras Burocráticas carentes de
razonabilidad materializadas, únicamente, en disposiciones administrativas. Para ello, el
primer capítulo versará sobre la regulación actual del procedimiento de eliminación de
Barreras Burocráticas y en el segundo capítulo se desarrollará el análisis de la inaplicación
con efectos particulares y generales de barreras burocráticas ilegales y carentes de
razonabilidad a propósito del Proyecto de Ley N°500-2021-CR.
The constitutional right to free private initiative, business freedom and free competition are not unlimited, while the exercise of said rights must not contravene the public interest; For this reason, it is necessary that the public administration, in function of the administrative police, establish measures such as requirements, prohibitions, collections, etc. legal and reasonable, in order to protect the general interests of the company. However, the entities of the administrations do not carry out an adequate analysis of the regulatory impact, which is why the economic agents are affected in terms of access and permanence in the market. However, the regulation for the elimination of bureaucratic barriers has been in constant change. Legislative Decree No. 1256 repealed Article 26 Bis of Decree Law No. 25868 and was published at the end of 2016. The purpose of this regulation was to strengthen Indecopi's powers. One of the novelties was the scope of the non-application with general effects of those Resolutions that declare illegal bureaucratic barriers materialized in administrative provisions; However, in the explanatory statement, it does not reflect an adequate justification regarding the exclusion of unreasonable Barriers, since in the latter the effects will fall solely on the complaining party and not on the others who are affected by the disputed measure. In this sense, the purpose of this report is to demonstrate and propose the feasibility of non-application with general effects on unreasonable bureaucratic barriers materialized solely in administrative provisions. For this, the first chapter will deal with the current regulation of Legislative Decree No. 1256 and in the second chapter the analysis of the non- application with particular and general effects of illegal bureaucratic barriers and care of reasonableness regarding Bill No. 500-2021-CR.
