Resumen
El presente trabajo aborda y desarrolla los principales aspectos jurídicos relacionados a
la competencia para la resolución de reclamos sobre un balón de GLP con desperfectos
en la válvula, la adecuada interpretación de consumidor final para considerar al
microempresario como tal, la disyuntiva entre infracción al deber de idoneidad o al deber
general de seguridad frente a desperfectos en la válvula de balones de GLP y, la naturaleza
que ostentan las medidas correctivas ordenadas por Indecopi. En tal sentido, al estar frente
a balones de GLP se analiza la competencia de OSINERGMIN sobre resolución de
reclamos, la configuración del requisito de asimetría informativa en los
microempresarios, la diferencia entre el deber de idoneidad y el deber general de
seguridad ante productos defectuosos y, la naturaleza indemnizatoria de las medidas
correctivas. De esta manera, se demuestra y sostiene que Indecopi cuenta con
competencia primaria para resolver reclamos referidos a balones de GLP, el
microempresario sí puede ser considerado consumidor final, los desperfectos en la
válvula de un balón de GLP que generan una explosión y un posterior incendio implica
una infracción al deber general de seguridad y, finalmente, la medida correctiva otorgada
por Indecopi sí tiene naturaleza indemnizatoria al encubrir un daño emergente.
This paper addresses and develops the main legal aspects related to the competence for the resolution of claims about an LPG cylinder with a defective valve, the proper interpretation of final consumer to consider the micro-entrepreneur as such, the disjunction between infringement of the duty of suitability or the general duty of safety in case of defects in the valve of LPG cylinders, and the nature of the corrective measures ordered by Indecopi. In this sense, when dealing with LPG cylinders, the competence of OSINERGMIN on the resolution of claims, the configuration of the requirement of information asymmetry in micro-entrepreneurs, the difference between the duty of suitability and the general duty of safety in case of defective products and the compensatory nature of the corrective measures are analyzed. In this way, it is demonstrated and sustained that Indecopi has primary competence to solve claims related to LPG cylinders, the micro-entrepreneur can be considered as final consumer, the flaws in the valve of an LPG cylinder that generate an explosion and a subsequent fire imply a breach of the general duty of safety and, finally, the corrective measure granted by Indecopi does have a compensatory nature as it covers an emerging damage.
