Resumen
Los hechos acontecidos durante la etapa de la Dictadura cívico-militar en Argentina han
trascendido hasta la actualidad por las graves violaciones de derechos humanos que se han
padecido en ese entonces y las consecuencias que conllevan. Así, el presente informe analiza
el Caso de la Familia Julien Grisonas, quien alude a Argentina como responsable
internacional de los hechos que se le practicaron durante la operación militar del 26 de
septiembre de 1976. Los mismos que transgredieron sus derechos reconocidos en la
Convención Americana de Derechos Humanos y actualmente se encuentran prohibidos en la
Convención Interamericana sobre Desaparición Forzada de Personas y en la Convención
Interamericana para Prevenir y Sancionar la Tortura.
En ese sentido, analizaremos los problemas jurídicos del presente Caso ante la Comisión
Interamericana de Derechos Humanos, en específico sobre el tiempo que tarda en emitir el
informe o elevarlo ante la Corte. Asimismo, se observará sobre los derechos alegados por la
parte demandante, observando que la Corte se extralimita al pronunciarse sobre algunos que
no son parte del petitorio y por reconocer el derecho a la búsqueda, el cual consideramos
pertinente, pero también observamos contradicciones con el derecho internacional.
Para concluir, consideramos importante que la Comisión Interamericana de Derechos
Humanos analice y emita sus Informes de manera célere con el objetivo de la protección de
los derechos humanos invocados en la petición. Además, señalamos que la Corte
Interamericana de Derechos Humanos es competente para interpretar las normas jurídicas
internacionales, mas no tiene permitido crear nuevos derechos
The events that occurred during the period of the civic-military dictatorship in Argentina have transcended to the present day due to the serious human rights violations that have been suffered at that time and the consequences that they entail. Thus, this report analyzes the Case of the Julien Grisonas Family, who alludes to Argentina as being internationally responsible for the acts that were carried out during the military operation of September 26, 1976. The same ones that violated their rights recognized in the American Convention of Human Rights and are currently prohibited in the Inter-American Convention on Forced Disappearance of Persons and in the Inter-American Convention to Prevent and Punish Torture. In this sense, we will analyze the legal problems of this Case before the Inter-American Commission on Human Rights, specifically on the time it takes to issue the report or submit it to the Court. Likewise, the rights alleged by the plaintiff will be observed, observing that the Court exceeds its limits when ruling on some that are not part of the petition and by recognizing the right to search, which we consider pertinent, but we also observe contradictions with the right international. To conclude, we consider it important that the Inter-American Commission on Human Rights analyze and issue its Reports promptly with the objective of protecting the human rights invoked in the petition. In addition, we point out that the Inter-American Court of Human Rights is competent to interpret international legal norms, but it is not allowed to create new rights.
