Resumen
El presente informe jurídico analiza la Resolución N° 0129-2018/SDCINDECOPI,
emitida por la Sala Especializada en Defensa de la Competencia de
Indecopi, la cual resolvió en segunda instancia la denuncia presentada por
América Móvil en contra de Entel por la presunta comisión de actos de engaño
en la difusión de los anuncios que formaron parte de su campaña publicitaria “La
Yapa”. Así pues, el presente trabajo evaluará si la decisión adoptada en dicha
resolución, en la cual se concluyó que Entel sí había incurrido en los actos de
competencia desleal denunciados, fue la correcta; ello sobre la base de lo
dispuesto en la Ley de Represión de Competencia Desleal, así como en atención
a los criterios adoptados en resoluciones de Indecopi.
De ese modo, luego de la investigación realizada en este informe, se demostrará
que Entel sí incurrió en actos de engaño en la difusión de los mensajes que
fueron materia de análisis en la segunda instancia. Ello pues, tras realizar una
interpretación superficial e integral de la publicidad, desde la perspectiva del
consumidor, se identificaron los dos mensajes objetivos cuestionados, los cuales
no respetaron el principio de veracidad. Por un lado, uno de los mensajes omitió
información que resultaba relevante para el proceso de elección de los
consumidores y, por otro lado, el otro mensaje presentó información falsa. En
consecuencia, se concluirá que ambos eran susceptibles de inducir a error a los
consumidores.
This legal report analyzes Resolution No. 0129-2018/SDC-INDECOPI, issued by the Specialized Chamber in Defense of Competition of Indecopi, which resolved in second instance the complaint filed by América Móvil against Entel for allegedly committing acts of deception in the dissemination of the advertisements that were part of its advertising campaign "La Yapa". Therefore, this paper will evaluate whether the decision adopted in such resolution, in which it was concluded that Entel had incurred in the acts of unfair competition denounced, was correct, based on the provisions of the Law for the Repression of Unfair Competition, as well as on the criteria adopted in Indecopi's resolutions. Thus, after the investigation carried out in this report, it will be demonstrated that Entel did incur in acts of deception in the dissemination of the messages that were subject of analysis in the second instance. After a superficial and integral interpretation of the advertising, from the consumer's perspective, the two objective messages in question were identified, which did not respect the principle of truthfulness. On the one hand, one of the messages omitted information that was relevant for the consumer's choice process and, on the other hand, the other message presented false information. Consequently, it will be concluded that both were likely to mislead consumers.
