Análisis de la capacidad jurídica de las personas con discapacidad intelectual sobre su libertad sexual

Resumen
El caso materia de análisis versa sobre la comisión del delito de Violación Sexual en
agravio de una persona con discapacidad intelectual que, a la fecha de los hechos, la
agraviada de iniciales A.C.CH. tenía la edad de 27 años, y a lo largo del proceso penal se
concluyó que la misma presentaba el diagnóstico de Retardo Mental Moderado y un
cuadro de Esquizofrenia. El tipo penal vigente al momento de los hechos regulaba la
“Violación de Persona en Incapacidad de Resistencia”, en donde de acuerdo con la
interpretación de la Corte Suprema, no se requiere que el retardo mental que presente la
agraviada, sea de una intensidad regularmente grave que no le permita conocer o valorar
lo que representan las prácticas sexuales para que se perfeccione el delito antes citado;
esto es, solo se requiere acreditar el diagnóstico de “retardo mental” para
automáticamente concluir la existencia del delito de violación sexual en agravio de una
persona con discapacidad intelectual. En ese sentido, el objetivo del presente trabajo es
poder determinar si una persona con discapacidad intelectual tiene la capacidad jurídica
para poder disponer sobre su libertad sexual, y finalmente señalar que, el artículo 172°
del Código penal deberá ser interpretado conforme a la Convención de Derechos de las
Personas con Discapacidad, a fin de garantizar la autonomía de las personas con
discapacidad, en igualdad de condiciones que los demás.
The case that is the subject of analysis deals with the commission of the crime of Sexual Rape to the detriment of a person with intellectual disability who, at the date of the events, the victim of the initials A.C.CH. was 27 years old, and had a diagnosis of Moderate Mental Retardation and Schizophrenia. The felony at the time of the events regulated the "Sexual Abuse of a Person in Resistance Disability", where according to the interpretation of the Supreme Court, it is not required that the mental retardation presented is regular intensity serious that does not allow him to understand what sexual practices represent. On the contrary, it is only required to prove the diagnosis of "mental retardation" to automatically conclude the existence of the crime of sexual abuse to the detriment of a person with intellectual disability. In this regard, the objective of this report is determining whether a person with intellectual disabilities has the legal capacity to consent sex, and be able to dispose of their sexual freedom, and finally to point out that Article 172 of the Criminal Code must be interpreted in accordance with the Convention of Rights of Persons with Disabilities, in order to guarantee the autonomy of persons with disabilities, under the same conditions as others.
