Abstract
La trata sexual de mujeres, desde sus inicios ha sido tipificada confusa e
incorrectamente. Las diversas vertientes sobre enfoques en la doctrina internacional,
así como la relación de estas con los tratados actuales hacen que el confuso
desarrollo se mantenga presente. A efectos del presente trabajo, se busca analizar si
es que el Perú ha incurrido en responsabilidad internacional al implementar el delito
de trata de mujeres con fines de explotación sexual por no proteger a la víctima en el
ordenamiento interno. Para confirmar dicha hipótesis, se analizan los elementos del
hecho internacionalmente ilícito y si existen circunstancias que excluyan de ilicitud del
hecho a fin de demostrar que el Perú ha incurrido en responsabilidad internacional
porque ha violado sus obligaciones internacionales sobre la protección de la víctima
en su implementación del delito de la trata de mujeres con fines de explotación sexual.
Since its beginnings, sex trafficking in women has been confusingly used and
incorrectly typified. The various aspects of approaches in international doctrine, as
well as their relationship to current treaties, mean that the confusing development
remains present. For the purposes of this investigation, we analyze whether Peru has
incurred international responsibility in implementing the crime of trafficking in women
for sexual exploitation because it has failed to protect the victim in its national law. To
confirm this hypothesis, the elements of the internationally wrongful act are analyzed
and whether there are circumstances that preclude the wrongfulness of the act in order
to demonstrate that Peru has incurred international responsibility because it has
violated its international obligations on the protection of the victim in its implementation
of the crime of trafficking in women for sexual exploitation.
