Abstract
El proceso hermenéutico de la norma subyace a toda rama del derecho, incluido
el ámbito minero, el cual representa una industria clave para el desarrollo del
país. La presente discusión jurídica surge de la interpretación que debe realizar
la autoridad administrativa sobre el artículo 36° del Texto Único Ordenado de la
Ley General de Minería, disposición que restringe la adquisición de concesiones
mineras a ciertos individuos, de modo que se garantice la protección de la
finalidad de la misma en consonancia con los principios generales del derecho.
En este caso, se advierte la solicitud de sustitución presentada por Newmont
Perú S.R.L. sobre el petitorio minero TACNA 101, cuyo titular es Back Arc
Minerals S.A.C. Esta empresa fue constituida y dirigida por un ex trabajador de
la compañía minera solicitante, quien tuvo acceso a información confidencial
sobre la geología de dicha área en el ejercicio de sus labores. En tal sentido, la
controversia se centra en analizar el alcance de la prohibición de la ley minera
cuando el sujeto impedido presenta un petitorio no a título personal, sino
utilizando una persona jurídica, lo que podría constituir un abuso de derecho o
fraude a la ley.
The hermeneutical process of the norm underlies every branch of law, including the mining field, which represents a key industry for the development of the country. The present legal discussion arises from the interpretation that the administrative authority must carry out on article 36 of the Single Ordered Text of the General Mining Law, a provision that restricts the acquisition of mining concessions to certain individuals, so as to guarantee the protection of its purpose in accordance with the general principles of law. In this case, the substitution request presented by Newmont Perú S.R.L. is noted. on the TACNA 101 petition, whose owner is Back Arc Minerals S.A.C. This company was established and directed by a former employee of the requesting mining company, who had access to confidential information about the geology of the area during his employment. In this sense, the controversy focuses on analyzing the scope of the prohibition of the mining law when the impeded subject presents a request not in a personal capacity, but using a legal entity, which could constitute an abuse of rights or fraud of the law.
