La nulidad de sentencia por omisión de pronunciamiento en el proceso civil peruano

Resumen
El presente estudio tiene como objetivo demostrar que la omisión de
pronunciamiento no es un vicio o defecto radical de nulidad, sino, todo lo
contrario, es perfectamente subsanable, incluso ex officio por el juez o tribunal.
Entonces, la omisión en el pronunciamiento -incongruencia omisiva- no debiera
acarrear la decretación de nulidad por parte de los tribunales superiores, a
diferencia de otro tipo de incongruencias (por exceso) donde sí ha llegado a
quebrar el principio de congruencia. Las propuestas de este trabajo consisten en
fortalecer el proceso civil, hacerlo más sencillo y ágil mediante alternativas
interpretativas de nuestra legislación y la comparación con realidades externas al
proceso civil peruano con la finalidad de encaminar a que el órgano judicial que
dictó una resolución incompleta, pueda integrar las omisiones de
pronunciamiento. Con este aporte, se evitaría la interposición de recursos de
índole ordinario y extraordinario o amparos contra resoluciones de este tipo,
generándose, con ello, una menor cantidad de resoluciones anulatorias.
The present study aims to demonstrate that the omission of pronouncement is not a vice or radical defect of nullity, but, on the contrary, it is perfectly rectifiable, even ex officio by the judge or court. Then, the omission in the pronouncement - omission inconsistency - should not lead to the decree of nullity by the higher courts, unlike other inconsistencies (by excess) where it has come to break the principle of congruence. The proposals of this work try to provide the civil process with simplicity and agility through interpretive alternatives of our legislation and comparison with realities external to the Peruvian civil process in order to direct the judicial body, which issued an incomplete resolution, to integrate the omissions of pronouncement. With this contribution, the filing of ordinary, extraordinary or amparo remedies against resolutions of this type would be avoided, generating, therefore, a lower number of annulment resolutions.
