Resumen
El presente trabajo analiza el expediente N° 01209-2006-AA/TC que se pronunció respecto
de la procedibilidad de un amparo contra una resolución referida a una medida cautelar. Esta
investigación busca unificar las decisiones en los procesos constitucionales respecto tres
problemas procesales identificados: primero, la procedencia del amparo contra una
resolución judicial que ordena una medida cautelar, segundo, se analiza la viabilidad de un
pronunciamiento sobre el fondo de parte del Tribunal Constitucional frente al rechazo liminar
de la demanda de amparo en dos instancias, y tercero, las consecuencias anulatorias de la
decisión del Tribunal Constitucional respecto del proceso ordinario, en caso emita un
pronunciamiento de fondo en el proceso de amparo. Para ello utilizamos el método deductivo
y descriptivo, comenzando por analizar los argumentos centrales del Juzgado, la Sala y del
Tribunal Constitucional. La investigación dio como resultado que sí es posible un amparo
contra una resolución judicial referida a una medida cautelar, en tanto sea firme en el proceso
cautelar. Asimismo, criticamos la emisión de un pronunciamiento sobre el fondo de parte del
Tribunal Constitucional luego de dos decisiones sobre la improcedencia del proceso de
amparo, pues trae como consecuencia que el Tribunal actúe como instancia única, afectando
así el debido proceso y la pluralidad de instancia.
This paper analyzes the case N° 01209-2006-AA/TC which ruled on the admissibility of an amparo claim against a judicial decision which issued a preliminary injunction. This research seeks to unify the decisions in the constitutional processes with respect to three identified procedural problems: first, the admissibility of the amparo against a judicial resolution that orders a preliminary injunction; second, it is analyzed the viability of a decision on the merits by the Peruvian Constitutional Court in the face of the preliminary inadmissibility of the amparo claim in two instances. For this purpose, we used the deductive and descriptive methods, starting by analyzing the central arguments of the first-degree court, the Appeal Committee and the Constitutional Court. The result of the investigation is that it is possible to issue an amparo claim against a judicial decision referring to a preliminary injunction as long as it is final decision in the injunction procedure. Likewise, we criticize the Constitutional Court's decision on the merits of the case after two decisions on the inadmissibility of the amparo claim, because it has the consequence that that Court acts as the sole instance, thus affecting the due process of law and the plurality of instances.
