Resumen
El caso de vacancia municipal al ex burgomaestre Jorge Vicente Martín Muñoz
Wells, llevado a cabo ante el Pleno del Jurado Nacional de Elecciones, cobra
especial relevancia en el contexto actual, pues de lo últimos diez (10) alcaldes
de Lima Metropolitana, es la primera vez que este logra ser vacado.
El problema principal al cual se buscará dar una respuesta conforme a derecho
es si en efecto, la autoridad edil del presente caso fue vacada correctamente, es
decir, si la vacancia fue legítima. De ello, las cuestiones controvertidas que se
desprenden en primer lugar, es determinar la naturaleza jurídica de la vacancia,
en segundo lugar, la prohibición de que un alcalde metropolitano pueda o no
asumir el cargo de director de una empresa estatal, y, por último, determinar si
se valoró el contexto de interés público relacionado a la aceptación del cargo
como directivo de SEDAPAL.
El estudio llevado a cabo es principalmente a través de un análisis dogmático y
jurisprudencial, y como principales conclusiones tenemos que, la vacancia es un
procedimiento sui generis, que la prohibición a que un alcalde sea directivo de
una empresa estatal no es directa, sino que se da a través de una remisión legal,
y que, no se valoró a fondo el marco de emergencia sanitaria en el cual la referida
autoridad aceptó el cargo.
The case of vacancy against the ex mayor Jorge Vicente Martín Muñoz Wells, that has been seen and resolved by the National Jury of Elections of Peru, is really important even more nowadays, because after the last ten (10) mayors of Lima, is the first time that the one could be vacated. The main problem is to figure it out if the municipal authority has been vacated was vacated correctly, that is, if the vacancy was legitimate. From this, the controversial issues that comes, is first, to determinate which is the legal nature of the vacancy, then, to see the if it is forbidden that a metropolitan mayor may or may not assume the charge of director of a state company. Finally, we will determine if the context of public interest was analyzed by the National Jury of Elections. To achieve it the study carried out mainly through a dogmatic and jurisprudential analysis, and as the main conclusions we have that, the vacancy is a sui generis procedure, that the prohibition on a mayor to be a director of a state company is not direct, and that the health emergency in which the authority accepted the position was not fully assessed
