Abstract
En el presente trabajo se realiza el análisis de la aplicación del régimen de
responsabilidad subjetiva en los procedimientos sancionadores en materia de
hidrocarburos, con énfasis en un estudio de casos referido a los incumplimientos a
normas de control de calidad de combustibles líquidos, control metrológico y SCOP. Se
analiza el régimen de responsabilidad subjetiva aplicada a casos concretos a fin de
verificar el cumplimiento de los fines del procedimiento sancionador en los casos
concretos, como acción de respuesta del Estado ante la cantidad de infracciones
verificadas en las supervisiones efectuadas. El trabajo parte de la importancia de
analizar la aplicación del Principio de Culpabilidad no solo desde la óptica de los
administrados, sino también desde la óptica del debido ejercicio de las funciones
sancionadoras de Osinergmin, las cuales buscan desincentivar los incumplimientos
detectados en las supervisiones.
En esta línea, se concluye del estudio de casos que la aplicación del régimen de
responsabilidad subjetiva en los procedimientos sancionadores tramitados por
Osinergmin por los incumplimientos analizados no incentiva el cumplimiento de los
fines del procedimiento administrativo sancionador, esto es cumplir con las
obligaciones normativas, ni los objetivos públicos de las normas del subsector
hidrocarburos, pues al considerar la debida diligencia del infractor, se tendría supuestos
en los cuales a pesar de haber incumplido la norma y no cumplirse los objetivos
públicos de la misma, el administrado puede liberarse de responsabilidad si acredita su
diligencia.
In the present work, the analysis of the application of the subjective responsibility regime in sanctioning procedures in hydrocarbons is carried out, with emphasis on a case study referring to quality control standards for liquid fuels, metrological control and SCOP. The regime of subjective responsibility applied to specific cases is analyzed in order to verify compliance with the purposes of the sanctioning procedure in specific cases, as a response action by the State to the number of infractions verified in the supervisions carried out. The work is based on the importance of analyzing the application of the Principle of Guilt not only from the point of view of the administrators, but also from the point of view of the due exercise of Osinergmin's sanctioning functions, which seek to discourage breaches detected in the supervisions. In this line, it is concluded from the case study that the application of the subjective liability regime in the sanctioning procedures processed by Osinergmin for the analyzed breaches does not encourage the fulfillment of the purposes of the administrative sanctioning procedure, that is, to comply with the normative obligations, nor the public objectives of the regulations of the hydrocarbon subsector, since when considering the due diligence of the offender, there would be cases in which, despite having breached the regulation and not fulfilling its public objectives, the company can be released from responsibility if it proves your diligence.
