Resumen
En los últimos años, han surgido posiciones difusas en relación a los límites de
la compensación bancaria cuando se trate de los fondos de la Cuenta de Ahorro
Sueldo cuyos depósitos son remuneración. No obstante, en el trasfondo, no se
realiza un análisis sustantivo de las figuras jurídicas como la compensación legal,
la compensación convencional, la inembargabilidad de las remuneraciones, los
contratos de consumo, entre otros, que resulta necesario para brindar una
protección adecuada a la remuneración sustancial y al ahorro del público, que a
su vez son fundamentos jurídicos de la protección al consumidor y la
compensación bancaria, respectivamente.
En este sentido, el objetivo principal de este informe ha sido realizar un análisis
sustantivo de las figuras jurídicas indicadas en la Resolución N° 476-2013/ILNCPC;
con la finalidad de determinar si la compensación realizada por el Banco
se realizó de acuerdo con lo establecido en el ordenamiento jurídico y, por ende,
acorde con el deber de idoneidad y motivación de la resolución administrativa.
Análisis sobre el cual se concluyó que la interpretación sistemática de Indecopi
sobre los límites de la compensación resulta aplicable a los créditos salariales
en el marco de una relación laboral, mas no una relación consumo con el caso
de análisis. Por lo tanto, el Banco sí realizó la compensación bancaria conforme
al ordenamiento jurídico peruano. Cabe indicar que, para el presente análisis, se
han utilizado instrumentos normativos como la legislación peruana y extranjera,
jurisprudencia y doctrina nacional e internacional.
In recent years, diffuse positions have arisen in relation to the limits of bank compensation when dealing with the funds of the Salary Savings Account whose deposits are remuneration. However, in the background, there is no substantive analysis of legal figures such as legal compensation, conventional compensation, unseizability of remunerations, consumer contracts, among others, which is necessary to provide adequate protection to substantial remuneration and public savings, which in turn are legal foundations of consumer protection and bank compensation, respectively. In this sense, the main objective of this report has been to perform a substantive analysis of the legal figures indicated in Resolution No. 476-2013/ILN-CPC; with the purpose of determining whether the compensation made by the Bank was carried out in accordance with the provisions of the legal system and, therefore, in accordance with the duty of adequacy and motivation of the administrative resolution. Analysis on which it was concluded that Indecopi's systematic interpretation of the limits of compensation is applicable to salary credits within the framework of an employment relationship, but not a consumer relationship with the case under analysis. Therefore, the Bank did perform the bank compensation in accordance with the Peruvian legal system. It should be noted that, for this analysis, normative instruments such as Peruvian and foreign legislation, jurisprudence and national and international doctrine have been used.
