El peso de la Ley: Impacto de la política pública de salud mental vinculada con los operadores de justicia en la calidad del sistema judicial peruano

Resumen
Este artículo busca determinar el vínculo que existe entre las
políticas de salud mental y la administración de justicia por parte de los
operadores de justicia: jueces, abogados y practicantes, en el ejercicio de sus
funciones. Así también reflexionar acerca de cómo es que la falta de
importancia a este tema repercute en la toma de decisiones y el ejercicio
laboral. Para ello, se hará una encuesta cualitativa, en aras de conocer la
situación emocional del grupo que será tomado como muestra para realizar la
evaluación correspondiente. Se evidencia que el tema de salud mental en
operadores de justicia ha sido dejado de lado, generando situaciones de
ansiedad, depresión, entre otros. En ese sentido, estamos desprotegiendo a
este grupo de personas que forma parte de la ciudadanía, pero que han
quedado aislados. Se concluye que la incorporación de políticas de salud
mental cumple un rol importante en el desempeño de la administración de
justicia; sin embargo, al no ser tomadas en cuenta, produce un nivel bajo de
satisfacción en la ciudadanía, así como en el desarrollo de la carrera judicial.
This article seeks to determine the link that exists between mental health policies and the administration of justice by justice operators: judges, lawyers and practitioners, in the exercise of their functions. Likewise, reflect on how the lack of importance of this issue affects decision-making and work practice. To do this, a qualitative survey will be carried out, in order to know the emotional situation of the group that will be taken as a sample to carry out the corresponding evaluation. It is evident that the issue of mental health in justice operators has been left aside, generating situations of anxiety, depression, among others. In that sense, we are failing to protect this group of people who are part of the citizenry, but who have been left isolated. It is concluded that the incorporation of mental health policies plays an important role in the performance of the administration of justice; however, when they are not taken into account, it produces a low level of satisfaction among citizens, as well as in the development of the judicial career.
