This is about an arbitration dispute between the Consorcio de Alimentos SAC (hereinafter, CORAL SAC) and the National Food Assistance Program (hereinafter, PRONAA). The dilemma arises when one of the means of transport in which the papilla product is transported suffers an accident and cannot comply with the delivery in the agreed time, for which reason THE ENTITY, due to this delay in the second delivery, does not pay the invoice. correspondent. Made before which. THE CONSORTIUM resorts to resolving THE CONTRACT and chooses to go through arbitration, a possibility enabled by the arbitration clause agreed upon by the parties involved. Given this, THE CONSORTIUM not only requests as a claim that the invoice that remains pending be paid, but also requires compensation for damages that will be analyzed in the following pages. Likewise, we will analyze the arbitration process, if it complied with its parameters, the claims that were requested, if they were correctly formulated and I will make an analysis of the position of the Arbitral Tribunal. Not being less important, I will carry out a brief study on the fortuitous event and force majeure applied additionally from Civil Law to Administrative Law, since this is a clear example of what happens every day in the delay and / or dilation of the deliveries of the administrative contracts, sometimes justified and sometimes not.
