Resumen
La resolución materia de estudio es la Resolución N° 10 del Expediente No
00382-2019-0-1817-SP-CO-01. El cuestionamiento a dicha Resolución es por
un defecto en la debida motivación que transgrede el reconocimiento de la
debida motivación como derecho y garantía constitucional en la Constitución
Política del Perú. Es así como es posible examinar tanto la justificación interna
como externa de la decisión judicial y los vicios en la motivación.
El defecto de la Resolución es la motivación aparente porque la decisión no
cumple con justificar el proceso para llegar a su decisión, sino por el contrario
realiza meras referencias al Laudo Arbitral sin pronunciarse sobre los
argumentos de las partes en la demanda de anulación de laudo.
Asimismo, el laudo objeto de cuestionamiento presenta cuestiones respecto al
concepto y procedimiento de recepción de obra que ameritan un desarrollo de
análisis, conforme la Ley de Contrataciones con el Estado y su Reglamento
vigentes al momento de celebrar el Contrato (Ley No. 26850 y Decreto
Supremo Nº 084-2004). Al respecto se desarrolla sobre la posibilidad de
modificar por acuerdo el procedimiento de recepción de obra, la entrega física
como cumplimiento de procedimiento de recepción de obra y sobre la
relevancia de las observaciones en el procedimiento de recepción de obra.
En conclusión, el presente trabajo plantea un análisis sobre aspectos
fundamentales relacionados con el derecho a una debida motivación, al mismo
tiempo que se plantea una reflexión crítica en torno al proceso establecido para
la recepción de obras según lo estipulado en la Ley de Contrataciones.
Las cuestiones que se abordan en este estudio resultan de suma importancia,
ya que se trata de garantizar el derecho a la debida motivación y que las
decisiones en el contexto de la contratación y recepción de obras estén
debidamente fundamentadas y basadas en criterios razonables.
Esta reflexión invita a replantear y analizar críticamente los mecanismos y
normativas existentes, con el objetivo de fortalecer los derechos y garantías de
las partes involucradas en los contratos de obra y fomentar la calidad y
cumplimiento de los proyectos en beneficio de la sociedad en su conjunto.
The resolution under study deals with Resolution No. 10 of File No Exp. 00382 2019-0-1817-SP-CO-01. The challenge to say Resolution is due to a defect in the due motivation that transgresses the recognition of the due motivation as a constitutional right and guarantee in the Political Constitution of Peru. Thus, it is possible to examine both the internal and external justification of the arbitration decision and the defects in the motivation. The defect of the Resolution is the apparent motivation because the decision does not comply with justifying the process to reach its decision, but on the contrary, it makes mere references to the Arbitral Award without pronouncing on the arguments of the parties in the claim for annulment of the award. Likewise, the award in question raises issues regarding the concept and procedure for the reception of the work that merit a further analysis, in accordance with the Law on State Contracting and its Regulations in force at the time of the execution of the Contract (Law No. 26850 and Supreme Decree No. 084-2004). In this regard, the possibility of modifying the work acceptance procedure by agreement, the physical delivery as compliance with the work acceptance procedure and the relevance of the observations in the work acceptance procedure are developed. In conclusion, this paper presents an analysis of fundamental aspects related to the right to due motivation, and at the same time, a critical reflection on the process established for the reception of works as stipulated in the Law on State Contracting. The issues addressed in this study are of the utmost importance, since the aim is to guarantee the right to due motivation and that decisions in the context of contracting and receiving works are duly grounded and based on reasonable criteria. This reflection invites to rethink and critically analyze the existing mechanisms and regulations, with the aim of strengthening the rights and guarantees of the parties involved in works contracts and to promote the quality and compliance of projects for the benefit of society as a whole.
