Abstract
El trabajo sobre la Casación N° 1494-2019/Cusco se centra en el desarrollo de
las notas característica referidas al delito de negociación incompatible. Para que,
abordándolo como un ilícito que protege los intereses estatales en el desempeño
objetivo de los funcionarios y servidores durante cualquier proceso deliberativo,
sea catalogado como un tipo penal que de acuerdo al grado de su lesión es de
peligro abstracto. Por tanto, las conductas orientadas a priorizar un intereés
indebido que debe entenderse en términos latos, no exige necesariamente el
despligue de acciones para el logro de un resultado. En atención a lo cual,
concluir que, en salvaguarda de los propósitos de la Administración pública, toda
conducta conscientemente peligrosa que atente el bien jurídico que cautele el
tipo de negociación incompatible es susceptible de merecer reproche penal, sin
dejar de observar el resarcimiento del daño.
Siendo el objetivo principal precisar el alcance de las conductas sancionables, la
doctrina especilazada y jurisprudencia nacional sobre la materia sustantiva y
procesal, guiarán el análisis en la clarificación del bien jurídico protegido,
definición del interes indebido y el elemento subjetivo diferente al dolo, así como
la justificación de la reparación civil; contribuyendo a proporcionar un marco más
claro para la aplicación cada vez mas acorde de la ley penal.
The Cassation N° 1494-2019/Cusco focuses on the development of the characteristic notes referring to the corruption offense of Incompatible negotiation. So that, addressing it as an offense that protects the state interests in the objective performance of officials and servants during any deliberative process, it is classified as a criminal type that according to the degree of its injury is of abstract danger. Therefore, behaviors aimed at prioritizing an undue interest that must be understood in broad terms, do not necessarily require the deployment of actions to achieve a result. In response to which, to conclude that, in safeguarding the purposes of the Public Administration, any consciously dangerous conduct that violates the legal good that safeguards the type of incompatible negotiation is likely to deserve criminal reproach, without Stop observing the compensation of the damage. Being the main objective to specify the scope of the punishable behaviors, the specialized doctrine and national jurisprudence on the substantive and procedural matter, will guide the analysis in the clarification of the protected egal good, definition of the undue interest and the subjective element different from deceit, as well as the justification of civil reparation; contributing to provide a clearer framework for the increasingly consistent application of the criminal law.
