Resumen
La investigación estudia el procedimiento administrativo seguido ante la comisión de una
falta leve dentro del Régimen Disciplinario de las Escuelas de Formación Policial de todo el
Perú, cuestionando el plazo que se le otorga al estudiante para impugnar la sanción impuesta,
toda vez que este plazo es de veinticuatro horas, tiempo que resulta insuficiente para ejercer
de manera adecuada la defensa del administrado, teniendo en cuenta que todos los
estudiantes se encuentran encuartelados, por lo que, resulta difícil para estos poder encontrar
los medios necesarios para defender su posición ante una sanción por infracción leve,
dejando muchas veces que estos se acumulen y puedan afectar posteriormente sus notas. De
esta manera, el objetivo de la investigación se enfoca en cuestionar el artículo 90° del
Reglamento del Decreto Legislativo N° 1318 que establece el plazo para impugnar las
sanciones impuestas por infracciones leves, considerando que el inciso 3 del artículo 139°
de la Constitución Política que señala sobre los principios y derechos de la función
jurisdiccional, indica que el debido proceso, es un principio-derecho debe ser observado en
todos los procedimientos. Por tanto, considerando que los estudiantes de las diversas
Escuelas de Formación Policial deben conducirse acorde al Decreto Legislativo N° 1318 y
a su reglamento, el Decreto Supremo N° 022-2017-IN, señalamos que el artículo 90° del
reglamento establece un plazo de veinticuatro horas, tiempo insuficiente para impugnar la
sanción por infracción leve, siendo imperioso la modificación a fin de garantizar el debido
procedimiento para el estudiante.
The investigation studies the administrative procedure followed before the commission of a minor offense within the Disciplinary Regime of Police Training Schools throughout Peru, questioning the term given to the student to challenge the imposed sanction, since this term is Twenty-four hours, which is insufficient time to adequately exercise the defense of the administrator, taking into account that all students are locked, so it is difficult for them to find the necessary means to defend their position against a sanction for slight infringement, many times allowing these to accumulate and may subsequently affect your grades. In this way, the objective of the investigation focuses on questioning Article 90 of the Regulation of Legislative Decree No. 1318 that establishes the term to challenge the sanctions imposed for minor infractions, considering that subsection 3 of Article 139 of the Constitution Policy that indicates the principles and rights of the jurisdictional function, indicates that due process, is a principle-right must be observed in all procedures. Therefore, considering that the students of the various Police Training Schools must conduct themselves in accordance with Legislative Decree No. 1318 and its regulations, Supreme Decree No. 022-2017-IN, we note that Article 90 of the regulations establishes a term of Twenty-four hours, insufficient time to contest the sanction for a minor offense, the modification being imperative in order to guarantee due procedure for the student.
